Common use of Payments to Company Clause in Contracts

Payments to Company. Except as provided in Sections 3 and 12 hereof, Company shall have no right or power to direct Trustee to return to Company or to divert to others any of the Trust assets before all payment of benefits have been made to the Plan participants and their beneficiaries pursuant to the terms of the Plan.

(a) Except as provided in Sections 3 3, 4(b), 4(c), 4(d), 5(b) and 12 12(c) hereof, after the Trust has become irrevocable, Company shall have no right or power to direct Trustee to return to Company or to divert to others any of the Trust assets before all payment of benefits have been made to the Plan participants and their beneficiaries pursuant to the terms of the PlanPlan(s) to the extent such benefits are obligations of Company.

Except as provided in Sections 2 or 3 and 12 hereof, the Company shall have no right or power to direct Trustee to return to Company or to divert to others any of the Trust assets before all payment payments of benefits have been made to the Plan participants Participants and their beneficiaries with respect to a Plan pursuant to the terms of the such Plan.
