Common use of Payments Upon Termination Clause in Contracts

Payments Upon Termination. In the event that the Executive’s employment with the Company is terminated for any reason, the Executive shall have the right to receive (i) the compensation and reimbursable expenses then accrued and/or earned and unpaid under Sections 4.1 and 5 of this Agreement through the date of termination, (ii) payment for unused vacation days accrued through the date of termination and (iii) any benefits required by the Consolidated Omnibus Budget Reconciliation Act of 1985.

In the event that the Executive’s employment with the Company under this Agreement is terminated for any reason, the Executive shall have the right to receive (i) the compensation be paid for all accrued, unpaid base salary and reimbursable expenses then accrued and/or earned and unpaid under Sections 4.1 and 5 of this Agreement all accrued, unused vacation, in each case through the date of termination, (ii) payment in accordance with applicable law. Executive shall also be reimbursed for unused vacation days accrued through the date any expenses incurred in accordance with Section 5.3 of termination and (iii) any benefits required by the Consolidated Omnibus Budget Reconciliation Act of 1985this Agreement.
