Common use of Peaceful Enjoyment Clause in Contracts

Peaceful Enjoyment. Landlord covenants that Tenant, on paying the yearly rent, and additional rent, and performing the covenants herein, shall and may peacefully and quietly have, hold and enjoy the Premises for the Term, provided, however, that this covenant shall be conditioned upon the retention of title to the Premises by Landlord. AND IT IS MUTUALLY UNDERSTOOD AND AGREED that the covenants and agreements contained in this Lease Agreement shall be binding upon the parties hereto and upon their respective successors, heirs, executors and administrators.

Peaceful Enjoyment. Landlord covenants that Tenant, on paying the yearly rent, and additional rent, and performing the covenants herein, Tenant shall and may peacefully and quietly have, hold and enjoy the Leased Premises for subject to the Termother terms hereof, provided, however, provided that no Event of Default exists under this Lease. It is understood and agreed that this covenant shall be conditioned upon the retention and any and all other covenants of title to the Premises by Landlord. AND IT IS MUTUALLY UNDERSTOOD AND AGREED that the covenants and agreements Landlord contained in this Lease Agreement shall be binding upon the parties hereto Landlord and upon its successors and assigns only with respect to breaches occurring during its and their respective successors, heirs, executors and administratorsownership of the Landlord's interest hereunder.
