Common use of Penal Restrictions Clause in Contracts

Penal Restrictions. Employees unable to attend work as a result of penal restrictions before trial, will be considered on leave of absence without pay until the decision of the court is known. The Article shall not apply where the Employer takes disciplinary action against the employee because the penal restriction has resulted from actions in the performance of the employee's duties or from actions which affect, or could reasonably be expected to affect, suitability for continued employment.
