Performance and Payment Bonds for Stages. 1-3 The Contractor, concurrently with the execution and delivery of this Agreement, shall provide security for the performance of its obligation to accomplish the implementation of Stages 1-3, through a Performance Bond issued by a surety listed in United States Department of the Treasury Listing of Approved Sureties (Department Circular 570). The Performance Bond shall be in the amount of $ , which is 100% of the Price for Stages 1-3 set forth in RFP Attachment S, Proposer Experience and Financial Condition Forms, line . A Payment Bond may be required pursuant to Section 2.4.11 of this Agreement. The Performance and Payment Bonds shall serve as additional security for the performance of the Contractor’s obligations, and in no event should the existence of the Performance and Payment Bonds or the stated amount thereof be construed to cap, liquidate or otherwise modify or limit the amount of damages payable by Contractor hereunder based on the occurrence of a Contractor event of default or other liability assumed by Contractor under this Agreement. Following Acceptance of Stage 1 of the Project, Contractor may substitute a Performance Bond in an amount equivalent to the sum of Contractor’s proposed cost for Task Orders 2 and 3, as reflected in Exhibit “B,” “Cost Proposal,” so long as the substitute Performance Bond complies with the previously stated requirements in all respects other than amount.

  • Performance and Payment Bonds The authority and responsibility for requesting performance and payment bonds shall rest with the Customer. Under this Contract, the Customer issuing the purchase order may request a performance and payment bond, as deemed necessary by the size of the job. Inability to provide a bond may result in the Contractor being found in default of the purchase order.

  • Performance and Payment Bond Contractor shall post with County, not later than ten (10) days of the execution of this Agreement, a performance and payment bond in the amount of one hundred percent (100%) of the total lump sum price in such form as is satisfactory to County. The bond shall be executed by a corporate surety company duly authorized and admitted to do business in the State of Texas and licensed to issue such a bond in the State of Texas.

  • PERFORMANCE AND PAYMENT BONDS FOR INDIVIDUAL ORDERS H-GAC’s contractual requirements DO NOT include a Performance & Payment Bond (PPB); therefore, Contractor shall offer pricing that reflects this cost savings. Contractor shall remain prepared to offer a PPB to cover any order if so requested by the END USER. Contractor shall quote a price to END USER for provision of any requested PPB, and agrees to furnish the PPB within ten business (10) days of receipt of END USER's purchase order.

  • Prices and Payment Terms 5.1 Order prices are net and do not include value added tax (“VAT”). VAT shall be payable in addition, where applica- ble and on receipt by us from the Supplier of a valid VAT invoice (or other relevant document required for the pur- pose of VAT recovery by us) except where some other express arrangement has been agreed.   • Compensation and Payment Terms A.
