Common use of Performance Based Requirements Clause in Contracts

Performance Based Requirements. A. All grounds shall, at all times meet the standards specified herein: B. The Contractor shall conform to all Federal, State, City, and Orange County standards, ordinances, codes, and regulations during the performance of the contract including but not limited to: C. It is the responsibility of the Contractor to obtain the latest version of said ordinance documents. Any fines levied due to inadequacies or failure to comply with any and all requirements shall be the sole responsibility of the Contractor. D. Any person found not in compliance with any laws, statues, rules or regulations will not be allowed to the work site. Continued violations by a Contractor shall constitute cause for immediate termination of the Contract. E. All services required under this contract shall be performed by the Contractor or under its supervision, and all personnel engaged in performing the series shall be fully qualified and, if required, authorized, licensed or permitted under state and local law to perform such services. F. The Performance Administrator, with advisement of the Contract Administrator, may request the Contractor to remove any employee (including supervisor and subcontractors) if it is determined that services are not being performed in accordance with the terms and conditions of this contract. G. The Contractor shall be required to attend any meetings requested by the Contract Administrator or Performance Administrator related to this contract.
