Common use of Performance of Agreement Clause in Contracts

Performance of Agreement. All covenants, conditions, and other ------------------------ obligations under this Agreement which are to be performed or complied with by Seller prior to the Time of Closing have been fully performed and complied with at or prior to the Time of Closing, including the delivery of the instruments and documents in accordance with Section 6.2.

Performance of Agreement. All covenants, conditions, and ------------------------ other ------------------------ obligations under this Agreement which are to be performed or complied with by Seller prior to the Time of Closing Purchaser and Xxxx Xxxxxx shall have been fully performed and complied with at or prior to the Time of Closing, including the delivery of the instruments and documents in accordance with Section 6.26.3.
