Common use of Period of Performance and Term Clause in Contracts

Period of Performance and Term. Unless earlier terminated as provided in Paragraph 10 of this Agreement, the Subaward Period of Performance shall start on July 1, 2021 and end on June 30, 2023. This Agreement shall remain in effect until receipt of final payment by SCDOA. The funding provided during the finite term of this subaward shall be used to assure vehicle preventative maintenance and record keeping extending throughout the useful life of the vehicle for the purposes of vehicle maintenance and repair. The vehicle use after final payment under this subaward will remain restricted to its intended use supported by the subaward recordkeeping obligations and maintenance agreements. Failure to do so will be deemed a breach of this subaward Agreement. The obligation to honor and fully perform those agreements shall survive the term of this subaward Agreement. Failure to meet this obligation will be considered in future competitive solicitation for subawards and program funds, and may be enforced by setoff from future subawards or program funds and also by any other means allowed by law.
