Common use of Personal Injury and Liability Insurance Clause in Contracts

Personal Injury and Liability Insurance. Whenever a teacher is absent from school as a result of personal injury arising out of and in the course of his/her employment and this injury results in eligibility for Worker’s Compensation, the teacher shall not be charged any loss of accumulated Sick Leave time; nor shall he/she suffer any loss in pay or benefits, provided the teacher remits to the Board any non-reimbursing payments from Worker’s Compensation.

Whenever a teacher is absent from school as a result of personal injury arising out of and in the course of his/her employment and while the teacher was acting pursuant to Board policy and administrative direction and this injury results in eligibility for Worker’s 's Compensation, the teacher shall not be charged any loss of accumulated Sick Leave time; nor shall he/she suffer any loss in pay shall have the option of 1) receiving such Worker's Compensation without salary and without deduction of accumulated sick leave, or benefits2) with salary and deduction of sick leave, provided the teacher remits Worker's Compensation payments are endorsed to the Board any non-reimbursing payments from Worker’s CompensationBoard.
