Sick Leave Bank. The school corporation agrees to, and hereby establishes a voluntary sick leave bank to which certificated persons may contribute unused sick leave days, and from which a contributing individual may draw sick leave days when the individual’s annual and accumulated sick leave days are exhausted, in accordance with the following provisions. Please see the definitions of sick leave under Article IV. 1. The sick leave bank shall apply to all persons employed by the school corporation whose employment requires the holding of a license issued by the Indiana Department of Education, whether or not any such person is a member of the bargaining unit to which this contract applies. 2. A “contributing individual” is one who, within the first thirty (30) days of the contract year, signs a contribution form. Such contribution form shall require the assigning of one (1) day of sick leave to the sick leave bank and an individual may contribute up to five (5) total days if so motivated during any enrollment period. 3. A person shall cease to be a contributing individual upon the failure of such individual to sign such contribution form and such individual shall thereafter not be entitled to draw any sick leave days from the sick leave bank until becoming a contributing member the following year. 4. Present and new faculty members who wish to become “contributing individuals” may do so by following the procedure in paragraph two (2). Staff who hire in after the annual enrollment period closes can still enroll under equivalent timelines as original enrollment period. 5. Use of the sick leave bank shall be subject to the following limitations: a. Sick bank leave shall be used on a teacher’s first day receiving no pay as long as the teacher has exhausted all accumulated sick days, as well as all annual sick and personal days. Days may need to be allotted retroactively to allow time for the sick bank committee to meet and review the request. In the event a teacher on sick bank leave returns to work and then finds it necessary on advice of a doctor to take additional leave for the same disability, no additional days shall be deducted subject to the approve of the Sick Bank Review Committee. b. In the even a teacher is disabled as a result of illness or injury of a different nature during the same school year, any additional sick leave bank time granted is subject to approval of the Sick Bank Review Committee. c. Sick Leave Bank. The purpose of sick leave bank benefits is to provide compensable leave coverage to teachers who are absent due to extended disability because of serious personal illness or injury. Teachers shall become eligible to receive sick leave bank benefits when they have been absent from work for ten (10) consecutive working days AND have exhausted all of their personal accumulated sick leave days. The requirement of being absent for ten (10) consecutive days is waived for individuals eligible for a FMLA or disability leave. The sick leave bank shall contain a maximum of 270 days. An eligible teacher shall receive the current contractual rate of pay while disabled for a period not to exceed 180 contracted teaching days, with committee review every forty five (45) school days. The sick leave bank committee will consist of three (3) representatives designated by the Association and two (2) representatives of the Board and the superintendent. In the case of a tie the issue will be heard by the full board of education. Application for sick leave bank benefits shall be made in writing to the sick leave bank committee through the Superintendent and shall include medical verification. The Superintendent shall convene the committee within five (5) work days. When a determination is made, the applicant will be informed in writing, with copies to the Superintendent, business manager and committee members. The administration office shall do all paperwork and record keeping. No eligible applicant will be denied the days that he/she has contributed. A record of each teacher's contribution shall be maintained by the administration office. The administration office shall furnish the association with a written statement at the beginning of each school year setting forth the total number of days in the sick leave bank and the number of sick leave days each member has contributed to the bank. The teacher shall pay back to the sick leave bank a minimum of three (3) days per year for each year worked until all days borrowed are repaid to the bank or the bank becomes full. Payment shall begin at the commencement of the school year that the teacher returns to work by deducting three (3) days from the teacher's yearly allotment for that year and from succeeding years until the amount borrowed is repaid. Sick Leave Bank. 18.1 A sick leave bank shall be established for use by participating employees when fifty- one per cent (51%) of those eligible indicate by written authorization their intent to participate. 18.2 All employees shall be eligible for voluntary participation in a sick leave bank after one (1) year employment in Xxxxxx County. 18.3 The sick leave bank shall be used only for the employee's personal debilitating illness, accident, or injury. 18.4 Employees shall have accrued a minimum of five (5) sick leave days left over from previous year or years before joining the sick leave bank. Each participating employee shall contribute one (1) day of sick leave in the first month of eligibility. A. Employees shall be eligible to join the sick leave bank on or before September 10 of each school year. B. Each participating employee shall contribute one (1) day of sick leave each time the bank balance falls below 25% of the number of members in the bank. No employee shall be required to contribute more than three (3) days in any school year. If a participating employee does not have sufficient number of accrued sick leave days to contribute, his/her participation in the bank shall be restricted until such time that he/she can make the required contribution. C. After a participating employee's accumulated sick leave has been exhausted, he/she shall be eligible to draw in ten (10) day increments, from the sick leave bank, for any one (1) illness, injury, accident, or complication thereof. A maximum of sixty (60) sick leave days per year can be utilized. In the event that the employee does not use all sick leave drawn from the bank, such days shall be returned to the bank. D. Each application shall be accompanied by a physician's statement. Photo static copies of the doctor's statement will not be accepted. The committee reserves the right to ask for a second opinion. Sick leave bank days may not be used for maternity except in the case of major complications. E. Extension applications for an initial illness, accident, injury, or complication thereof will be submitted within seven (7) days of the beginning date of the original or previous application. F. Any participating employee withdrawing sick leave days shall not be required to replace those days except as a regular contributing member to the sick leave bank.
Sick Leave BankA sick leave bank shall be constituted as follows: 1. Each qualified individual shall, upon being credited by the School Corporation with any sick leave days, contribute one (1) of such sick days received to the Sick Leave Bank Account and shall similarly contribute additional days, but no more than one (1) each year, in subsequent years as required by this Contract. To effect such contributions, the School Corporation shall note upon the appropriate record or records of each such individual the deduction of one (1) sick leave day to be contributed to the sick leave bank. 2. Days which are thus placed in the sick leave bank shall, if unused, accumulate from school year to school year to a maximum of three thousand (3000) days. 3. Following the initial contributions hereunder, contributions of one (1) day each school year shall be made by each qualified individual in the Corporation at the beginning of each school year subsequent to 1976-77. The School Corporation shall in no event be required to deduct from the sick leave accounts of any individual, for contribution to the sick leave bank, any fractional days, nor shall it be required to deduct from the accounts of some qualified individuals but not others. 4. The Association shall have the full right and responsibility to promulgate the rules and regulations governing use of such sick bank days and to administer such bank, except as restricted by this Collectively Bargained Contract or by applicable law. 5. Rules and regulations governing use of such sick leave bank days, which rules and regulations shall be promulgated by the Association, shall be in writing. The Association shall provide a copy of such rules and regulations to any qualified individual upon reasonable request, shall provide a copy (including any updated editions) of such rules and regulations to the Superintendent of Schools within a reasonable time after their promulgation (or in the case of a new edition, their compilation), and shall advise the School Corporation in writing of any changes in such rules or regulations within a reasonable time following such changes. 6. The term "qualified individual" shall include all members of the bargaining unit. Any rules and regulations governing bank usage shall not distinguish between Association Members and Association Non-Members but shall apply without discrimination to all such categories. 7. Sick Leave Bank. A. The Board agrees to continue the established Sick Leave Bank in cooperation with the Association. Upon application to utilize the Sick Leave Bank, a teacher shall complete an FMLA application and provide a statement by the attending physician verifying the need and approximate duration of the illness. A statement by a second physician may be required upon the recommendation of either the Board or the Association provided that such physician shall be agreed to jointly by the Board and the Association. The Board shall be responsible for the cost of the statement from the second physician. Specific stipulations of the Sick Leave Bank are as follows: 1. To establish membership to the sick leave bank, each participating teacher, upon employment, shall have thirty (30) work days to voluntarily donate two sick leave days to the Sick Leave Bank. 2. The maximum number of sick leave days which may be borrowed from the bank by any participating teacher after exhausting individual accumulated sick leave, shall be 180 days regardless of the number of school years or calendar days involved or the number of illnesses involved. 3. Sick bank days may be borrowed only for the personal illness or disability of the employee and cannot be used to extend a leave of absence after the attending physician certifies the employee’s fitness to return to work. 4. Any participating teacher finding it necessary to use bank days after exhausting accumulated sick leave days, agrees to repay the Sick Leave Bank at the rate of a minimum of five (5) days per year over a period of consecutive years immediately following return to active employment with the School Corporation. 5. Any participating teacher finding it necessary to borrow sick leave bank days and subsequently electing not to return to active employment (should his/her health permit-eligibility to be determined by appointed or approved physician) with the School Corporation, or electing to accept employment elsewhere, shall repay the School Corporation in cash for the Sick Leave Bank days borrowed in an amount equal to that paid the respective substitute during the time the teacher borrowed from said bank, but in no case more than the teacher would have earned. Sick Leave Bank. A voluntary sick leave bank shall be established whereby a certificated school employee, who is absent from assigned duties due to personal illness and who has utilized all sick leave, personal leave, and all other paid leave benefits of whatever nature may petition a committee, as established herein, for sick leave days from the bank under the following conditions: A. The number of accumulated days in the bank shall not exceed one hundred seventy-five (175) days, provided, however, that (a) a veteran teacher who is not a current member of the bank may become a member by contributing one (1) sick leave day to the bank not earlier than August 1st nor later than September 15th of any school year, and (b) a teacher who is newly hired in this School Corporation shall have fifteen (15) days from the date of initial duty assignment, or until September 15th of any school year, whichever is later, during which time such teacher may choose to participate in the bank by contributing one (1) sick leave day, even though such contribution by such veteran or newly hired teacher would cause an accumulation of days in excess of the maximum specified herein; B. Said teacher may be granted days from the bank under the following conditions: 1. The teacher must have chosen to become a current member of and participate in such bank by contributing one (1) sick leave day to the bank not earlier than August 1st nor later than September 15th each year, and such day contributed shall be non-returnable to the teacher. However, in the event that the number of accumulated days in the bank at the beginning of a school year is of sufficient number that a contribution of one (1) sick leave day by all teachers who are current members of the bank would cause the maximum number of days specified hereinabove in Paragraph One (1) to be exceeded, the current year's contribution by all such current members shall be suspended, except that in case the bank is depleted during the school year, the current year's contribution shall be assessed at the time of such depletion; 2. Sick Leave Bank. A voluntary sick leave bank shall be established whereby a teacher may participate by contributing one (1) sick leave day under the following conditions: a. The number of accumulated days in the bank shall be adjusted on an annual basis to accommodate new teachers into the bank but shall not exceed 200 days. If the days in the bank fall below 50, members shall contribute an additional day. b. The teacher may be granted days from the bank under the following conditions: (1) He must have chosen to participate by contributing one (1) sick leave day to the bank on or before September 15th of the present year, and such day(s) contributed shall be non-returnable to the teacher. (8) All new employees may contribute one sick leave day to become a member of the sick leave bank. (9) Days will be granted for maternity leaves only for the period of time during which the teacher is certified as disabled. (10) The Federation will receive a count of days and members in the sick leave bank by October 15 of each year. c. A three (3) member sick leave bank committee shall be established to receive written requests and allot days from the bank according to guidelines established by the Committee. The Committee shall be composed of two (2) teachers appointed by the Federation plus the Superintendent. Days allotted by the Committee to an individual teacher shall be available for use after exhaustion of the teacher’s accumulated sick leave, and such allotment by the Committee shall not exceed a maximum of twenty (20) days. d. Sick Leave Bank. A. The Sick Leave Bank will continue in effect. B. Effective July 1, 1980, membership in the bank was voluntary for all employees. Thereafter, all new employees who request membership will be assessed one day of sick leave for deposit in the bank. C. A member of the bargaining unit may participate in the bank only after: 1. Filing application with the Sick Leave Bank Committee; 2. Submitting satisfactory medical evidence of the illness; 3. Submitting evidence of having exhausted all accumulated leave; 4. New employees must join the Sick Leave Bank within the first thirty (30) days of their employment or lose their right to do so. G. Employees may relinquish their membership in the sick leave bank at any time; if they do so, however, they will lose both their contribution in the Sick Leave Bank and their right to rejoin the bank at a later date. H. A member will lose the right to utilize the Sick Leave Bank if his employment with the Baltimore City Public School System is terminated. I. All contributions will remain in force and cannot be returned even upon cancellation of a membership. In no case will the granting of leave from the bank cause a member to receive more than his or her annual salary. J. All unused sick leave days in the bank at the end of a school year shall be carried over to the next school year.
Sick Leave Bank a. Upon the date of execution of this Agreement, there shall be established, or continued in the case of those Colleges having previously so established, a Sick Leave Bank. b. During the term of this Agreement, a unit member who is not a member of the Sick Leave Bank will automatically become so during the month of October. Seven and one-half (7.5) hours [one (1) day] of that unit member’s personal sick leave accumulation will be assigned to the sick leave bank. If a unit member does not want to be a member of the sick leave bank, that unit member shall provide by October 30 written notice to the President of the College or the President’s designee that the unit member is not assigning to the Employer seven and one-half (7.5) hours [one (1) day] of that unit member’s personal sick leave accumulation. c. The President of the College or the President’s designee shall maintain a register of the membership and the number of sick leave days accumulated in the Bank. d. Five (5) working days after the exhaustion of a sick leave bank member’s personal sick leave accumulation, compensatory time, and personal leave accumulation, every member of the Sick Leave Bank shall be entitled to draw upon the Sick Leave Bank, effective thereafter upon notice to the President of the College. The granting of such sick leave shall be subject to the same criteria as regular sick leave days and shall be in all other respects consistent with Employer policy; provided, however, that such sick leave shall be available only for the illness of the employee and not for the illness of the family. e. Whenever the accumulation of sick leave days in the Sick Leave Bank shall have fallen to three hundred seventy-five (375) hours [fifty (50) days], the President of the College or the President’s designee shall notify all members. Thereafter, seven and one-half (7.5) hours [one (1) personal sick leave day] from each member's accumulated sick leave shall be assigned to the Bank unless a member notifies the President of the College or the President’s designee in writing within five (5) days of receipt of said notice that that member does not wish to remain a member; provided, however, that any member of the Sick Leave Bank wishing to remain a member thereof and who shall have exhausted that member’s personal sick leave accumulation on the date of the giving of such notice, shall assign such additional days within fifteen (15) days after the date on which such member is entitled to personal sick l...
