PHASE I - SCHEMATIC DESIGN. 323T .123T Based upon the mutually agreed-upon Project program, schedule and budget by OWNER and DESIGN PROFESSIONAL, and after taking into consideration the comments and recommendations from CONTRACTOR, if the CONTRACTOR was under contract with the OWNER prior to the start of this phase, DESIGN PROFESSIONAL shall prepare, Phase I - Schematic Design Documents in compliance with the Project Program Documents and the requirements set forth under this section of this Agreement for approval by OWNER. OWNER’S acceptance of Phase I - Schematic Design Documents in no way relieves DESIGN PROFESSIONAL of its obligation to deliver complete and accurate documents necessary for successful construction of this Project.
