Common use of Physical Architectures Clause in Contracts

Physical Architectures. 4.2.1 In each LATA identified in Schedule 4.0, the Parties shall utilize the Covad-IP(s) and BA-IP(s) designated in such Schedule as the points from which each Party will provide the transport and termination of traffic. 4.2.2 Covad shall have the sole right and discretion to specify any of the following methods for interconnection at any of the BA-IPs: (a) a Physical or Virtual Collocation facility Covad establishes at the BA-IP; (b) a Physical or Virtual Collocation facility established separately at the BA-IP by a third party with whom Covad has contracted for such purposes; and/or (c) an entrance facility and transport (where applicable) leased from BA (and any necessary multiplexing), where such facility extends to the BA-IP from a mutually agreed to point on Covad's network. 4.2.3 Covad shall provide its own facilities or purchase necessary transport for the delivery of traffic to any Collocation arrangement it establishes at a BA-IP pursuant to Section 13. BA shall provide the transport and termination of the traffic beyond the BA-IP. 4.2.4 Covad may order from BA any of the Interconnection methods specified above in accordance with the order intervals and other terms and conditions, including, without limitation, rates and charges, set forth in this Agreement, in any applicable Tariff(s), or as may be subsequently agreed to between the Parties. 4.2.5 BA shall have the sole right and discretion to specify any one of the following methods for Interconnection at any of the Covad-IPs: (a) upon reasonable notice to Covad, a Physical Collocation facility BA establishes at the Covad-IP; (b) a Physical or Virtual Collocation facility established separately at the Covad-IP by a third party with whom BA has contracted for such purposes; and/or (c) an entrance facility leased from Covad (and any necessary multiplexing), where such facility extends to the Covad-IP from a mutually agreed upon point on BA's network. 4.2.6 BA shall provide its own facilities or purchase necessary transport for the delivery of traffic to any Collocation arrangement it establishes at an Covad-IP pursuant to Section 13. Covad shall provide the transport and termination of the traffic beyond the Covad-IP. 4.2.7 BA may order from Covad any of the Interconnection methods specified above in accordance with the order intervals and other terms and conditions, including, without limitation, rates and charges, set forth in this Agreement, in any applicable Tariff(s), or as may be subsequently agreed to between the Parties. 4.2.8 Under any of the architectures described in this subsection 4.2, either Party may utilize the Traffic Exchange Trunks for the termination of InterLATA Toll Traffic in accordance with the terms contained in Section 5 below and pursuant to the other Party's Switched Exchange Access Service tariffs. The other Party's Switched Exchange Access Service rates shall apply to such Traffic.

To the extent required by the Act, BA will make available to ANTC any other technically feasible method of interconnection, using the Bona Fide Request process set forth in Exhibit B. 4.2.3 Covad ANTC shall provide its own facilities or purchase necessary transport for the delivery of traffic to any Collocation arrangement it establishes at a BA-IP pursuant to Section 13. BA shall provide the transport and termination of the traffic beyond the BA-IP. 4.2.4 Covad NEXTLINK may order from BA any of the Interconnection methods specified above in accordance with the order intervals and other terms and conditions, including, without limitation, rates and charges, set forth in this Agreement, in any applicable Tariff(s), or as may be subsequently agreed to between the Parties. Schedule 27.2 hereto sets forth the applicable performance monitoring reports, standards, and remedies intended to ensure compliance with the provisions of this subsection. 4.2.5 BA shall have the sole right and discretion to specify any one of the following methods for Interconnection at any of the CovadNEXTLINK-IPs: (a) upon reasonable notice to CovadNEXTLINK, a Physical Collocation facility BA establishes at the CovadNEXTLINK-IP; (b) a Physical or Virtual Collocation facility established separately at the CovadNEXTLINK-IP by a third party with whom BA has xas contracted for such purposes; and/or (c) an entrance facility leased from Covad NEXTLINK (and any necessary multiplexing), where such facility extends to the CovadNEXTLINK-IP from a mutually agreed upon point on BA's ’s network. 4.2.6 BA shall provide its own facilities or purchase necessary transport for the delivery of traffic to any Collocation arrangement it establishes at an CovadNEXTLINK-IP pursuant to Section 13. Covad NEXTLINK shall provide the transport and termination of the traffic beyond the CovadNEXTLINK-IP. 4.2.7 BA may order from Covad NEXTLINK any of the Interconnection methods specified above in accordance with the order intervals and other terms and conditions, including, without limitation, rates and charges, set forth in this Agreement. If NEXTLINK's rates and charges are not established in this Agreement, then the applicable rates and charges shall be those established in any NEXTLINK's Tariffs If NEXTLINK's rates and charges are established neither in this Agreement nor in NEXTLINK's Tariffs then the applicable Tariff(s), or as may rates and charges shall be subsequently agreed to between the Partiesthose established in BA's Tariffs. 4.2.8 Under any of the architectures described in this subsection 4.2, either Party may utilize the Traffic Exchange Trunks for the termination of InterLATA Toll Traffic in accordance with the terms contained in Section 5 below and pursuant to the other Party's Switched Exchange Access Service tariffs. Covad shall provide the transport and termination of the traffic beyond the Covad-IP. 4.2.7 4.4.6 BA may order from Covad Transwire any of the Interconnection methods specified above in accordance with the order intervals and other terms and conditions, including, without limitation, rates and charges, set forth in this Agreement, in any applicable Tariff(s), or as may be subsequently agreed to between the Parties. 4.2.8 4.4.7 Under any of the architectures described in this subsection 4.2section 4.4, and subject to mutual agreement between the Parties, either Party may utilize the Traffic Exchange Trunks for the termination of InterLATA Toll Traffic in accordance with the terms contained in Section 5 below and pursuant to the other Party's Switched Exchange Access Service tariffsTariffs. The other Party's Switched Exchange Access Service rates shall apply to such Trafficfacilities. 4.4.8 The publication “Bellcore Technical Publication GR-342-CORE; High Capacity Digital Special Access Service, Transmission Parameter Limits and Interface Combination” describes the specification and interfaces generally utilized by BA and is referenced herein to assist the Parties in meeting their respective Interconnection responsibilities. 4.4.9 In recognition of the large number and variety of BA-IP’s available for use by Transwire, Transwire’s ability to select from among those points to minimize the amount of transport it needs to provide or purchase, and the fewer number of Transwire-IP’s available to BA to select from for similar purposes, Transwire shall charge BA no more than a non-distance sensitive Entrance Facility charge as provided in Exhibit A for the transport of traffic from a BA-IP to a Transwire-IP in any given LATA. In the case that Transwire delivers traffic at a point of Interconnection that is not the BA-IP for the traffic delivered, Transwire shall deliver such traffic over separate non-switched trunks directed to the relevant Interconnection Point.

BA shall provide the transport and termination of the traffic beyond the BA-IP. 4.2.4 Covad ACI may order from BA any of the Interconnection methods specified above in accordance with the order intervals and other terms and conditions, including, without limitation, rates and charges, set forth in this Agreement, in any applicable Tariff(s), or as may be subsequently agreed to between the Parties. 4.2.5 BA shall have the sole right and discretion to specify any one of the following methods for Interconnection at any of the CovadACI-IPs: (a) upon reasonable notice to CovadACI, a Physical Collocation facility BA establishes at the CovadACI-IP; (b) a Physical or Virtual Collocation facility established separately at the CovadACI-IP by a third party with whom BA has contracted for such purposes; and/or (c) an entrance facility leased from Covad ACI (and any necessary multiplexing), where such facility extends to the CovadACI-IP from a mutually agreed upon point on BA's network. 4.2.6 BA shall provide its own facilities or purchase necessary transport for the delivery of traffic to any Collocation arrangement it establishes at an CovadACI-IP pursuant to Section 13. Covad ACI shall provide the transport and termination of the traffic beyond the CovadACI-IP. 4.2.7 BA may order from Covad ACI any of the Interconnection methods specified above in accordance with the order intervals and other terms and conditions, including, without limitation, rates and charges, set forth in this Agreement, in any applicable Tariff(s), or as may be subsequently agreed to between the Parties. 4.2.8 Under any of the architectures described in this subsection 4.2, either Party may utilize the Traffic Exchange Trunks for the termination of InterLATA Toll Traffic in accordance with the terms contained in Section 5 below and pursuant to the other Party's Switched Exchange Access Service tariffs.
