Common use of Plant Clause in Contracts

Plant. To carry out general day to day servicing and maintenance of the Plant and maintain the same in good working order and generally in accordance with the manufacturers specifications and in accordance with all relevant Health and Safety Enactment. Provided that:- (a) nothing in this clause shall require the Tenant to make good any loss or damage by Insured Risks; (b) the Tenant shall not be or become liable under or by virtue of any of the provisions of this clause to renew or replace any of the Plant save where the need for such renewal or replacement arises in consequence of the misuse of it by the Tenant. or failure of the Tenant to repair and maintain it in accordance with the provisions of this clause.
