Post 90 Day Lifetime Limit Catastrophic Leave Level 2. If a Participant exhausts their 90 day lifetime withdrawal limit from the catastrophic leave bank level 1, SACP may notify Unit Members of the option to voluntarily donate up to five (5) days of accrued sick leave to the individual. For purposes of this section a “day” means full time Unit Members’ days. Less than full time Unit Members may donate their pro- rata portion of a full time Unit Members’ day. SCSS will accept up to 45 days of donated sick leave per request. A Unit Member is not limited to one (1) request. However, Unit Members can use up to forty-five days* within thirty-six (36) months of the request. In all cases, Unit Members donating accrued sick leave must maintain a minimum of three times the amount of the donated leave, e.g. if an employee donates five (5) days, they must have at least fifteen (15) days of accrued sick leave remaining. Voluntary donation of accrued sick leave is irrevocable. Donated leave in excess of leave taken shall remain in the catastrophic leave bank for subsequent requests. SACP shall provide Human Resources with signed written authorizations to donate sick leave no later than 45 days after the Association has sent the request to Unit Members. Although donated sick leave may extend the time the Employee receives full pay, it shall not extend the differential/extended sick leave authorized by the Education Code. *As long as there are sufficient funds, 11.11.4.8, sufficient funds.
