Catastrophic Leave Bank. The City agrees to establish a Catastrophic Leave Bank to assist employees who have exhausted accrued leave time due to a serious or catastrophic illness or injury. The Catastrophic Leave Bank (CLB) will allow the bargaining unit employees to donate time to affected employees within and outside the unit, so that he/she can remain in a paid status for a longer period of time, thus partially ameliorating the financial impact of the illness, injury or condition. This donated time will be placed in a CLB and drawn down from the CLB by the eligible employee. Eligibility To be eligible for this benefit, the receiving employee must: 1) Be a regular full time employee, 2) Have sustained or have an immediate family member who has sustained a life threatening or debilitating illness, injury or condition which may require confirmation by a physician, 3) Have exhausted all accumulated paid leave including vacation, holiday, sick leave, and/or compensatory time off, 4) Be unable to return to work for at least 30 days or in the case of the condition affecting the immediate family member, that member must be in need of prolonged and significant personal care; and 5) Conformed with the requirements of the Family Medical Leave Act and/or Worker's Compensation.

Catastrophic Leave Bank. 15 The intent of the Catastrophic Leave Bank (CLB) is to provide support for any active unit member 16 when a member of their family suffers from a catastrophic illness or injury. “Catastrophic illness" or 17 "injury" is a life-threatening or critical event which incapacitates a family member and requires the 18 unit member to take time off from work. 19 11.12.1 For the purpose of this article, “family member" is defined as spouse, domestic 20 partner, child, step child, xxxxxx child, parent or stepparent. 21 11.12.2 The unit member must have exhausted all qualifying paid leave in order to draw 22 from the CLB. 23 11.12.3 All bargaining unit members may become members of the CLB by voluntarily 24 contributing one (1) Personal illness/Personal Necessity day for the establishment and 25 maintenance of the Bank. Only contributors will be allowed to withdraw from the CLB. All 26 donations of eligible leave credits are irrevocable. 27 11.12.3.1 Contributions to the CLB may be made during the District's certificated benefit 1 open enrollment period. The Association will notify unit members of the open 2 enrollment period and the District will provide a CLB Membership Enrollment form 3 for unit members. 4 11.12.3.2 Employees who elect NOT to join the CLB during the open enrollment period or 5 within 30 days of being hired, will become eligible for membership in the following 6 open enrollment period. 7 11.12.3.3 Unit members must have a minimum of nine (9) days of Personal illness leave after 8 contribution of one (1) day has taken place. 9 11.12.3.4 At the beginning of a school year, newly hired unit members or unit members 10 returning from a leave of absence shall be granted a thirty (30) day window in 11 which to contribute a day to the CLB. 12 11.12.3.5 Cancellation occurs automatically whenever a unit member fails to make their 13 necessary contribution during the open enrollment period or during the annual 14 assessment. The unit member will not be able to withdraw from the CLB as of the 15 effective date of cancellation. 16 11.12.4 Days in the CLB will accumulate from year to year, up to four hundred (400) days. 17 11.12.4.1 During an open enrollment period where the CLB's total days are four 18 hundred (400) days, the CLB yearly contributions shall be suspended until which 19 time the next enrollment period falls below four hundred (400) days. Current CLB 20 members continue as members the following year. New CLB members will be 21 enrolled under 11.12.3...
Catastrophic Leave Bank. 11.14.1 The Association and the District agree to establish a Catastrophic Leave Bank. The Association will have complete administration and authority over this bank.
Catastrophic Leave Bank. The District shall establish a Catastrophic Leave Bank to which eligible unit members may donate earned and unused sick and/or vacation leave. Unit members who wish to donate may do so by completing the “Catastrophic Leave Donation Form” and returning it by the posted deadline. Donations are confidential, irrevocable, and cannot be rescinded for any reason whatsoever. A donation to the Catastrophic Leave Bank shall be a general donation and shall not be donated to a specific unit member for exclusive use. The maximum number of hours which may be accumulated in the Catastrophic Leave Bank is 1,280 hours (160 days).

Catastrophic Leave Bank. ‌ The District shall establish and maintain a Catastrophic Leave Bank which allows bargaining unit members and other employees to donate accrued leave to other employees who have exhausted or will exhaust their accrued leave due to the employee’s own health condition, or a health condition of a member of the employee’s immediate family. Immediate Family shall be defined as an employee’s spouse, registered domestic partner, child (including step or xxxxxx child), or a person defined as a dependent for Income Tax purposes. The Catastrophic Leave Bank will include the following terms and conditions: • All full-time regular and probationary employees shall be eligible to apply for and receive paid leave from the Catastrophic Leave Bank. • Time donated or given will be a one hour for one hour exchange, no conversions, based upon the requesting employee’s rate. • The catastrophic leave bank will have a maximum cap of 500 hours. The Catastrophic Leave Bank shall not be initiated until the employee’s leave balances (annual leave, floating holidays, and comp time bank) are completely exhausted. In order to be eligible to receive paid leave from the Catastrophic Leave Bank due to an employee’s own health condition, an employee must provide a physician’s statement that the employee’s health condition is such that the employee is currently unable to perform his/her regular duties and that provides an estimate of the length of time the employee’s health condition will be such that the employee is unable to perform his/her regular duties. If an employee is eligible for FMLA, the employee must apply FMLA leave while using the Catastrophic leave bank. In order to be eligible to receive paid leave from the Catastrophic Leave Bank due to the health condition of a member of an employee’s immediate family, an employee must provide a physician’s statement that the health condition of the member of the employee’s immediate family is such that the employee must take time off from work to provide care for that person and an estimate of the length of time the employee will need to take time off from work to provide such care. If an employee is eligible for FMLA, the employee must apply FMLA leave while using the Catastrophic leave bank. An employee who meets the conditions of eligibility for the receipt of paid leave from the Catastrophic Leave Bank shall be entitled to receive up to 320 hours of such leave in a 12-month period, provided that there are a sufficient number of hours...
Catastrophic Leave Bank. 16.1 Any unit member may donate up to five (5) days accumulated and unused sick leave days, in full-day or half-day increments to a specifically named unit member who has suffered or whose immediate family member has suffered a long-term illness or disability and who has exhausted all fully paid leaves. No unit member may donate more than five (5) days accumulated and unused sick leave days in any school year (July 1 through June 30). 16.2 Use of donated sick leave shall be capped at no more than 50 days per individual unit member per school year. 16.3 The Association agrees that it will not file, on its own behalf or on behalf of any unit member, any grievance, claim or lawsuit of any kind related to any attempt by a unit member to retrieve donated sick leave used by another unit member pursuant to this provision. The Association also agrees that it will not file, on its own behalf or on behalf of any unit member, any grievance, claim or lawsuit of any kind which attempts to challenge in any way the legality or enforcement of this provision. 16.4 The Association agrees to indemnify and hold harmless the District from any loss or damages arising from the implementation of this provision. 16.5 In the event of any grievance, claim or lawsuit challenging the legality or enforcement of this provision, the District may terminate this provision upon written notice to the Association.
Catastrophic Leave Bank. 9.10.1 Unit members may apply for and be eligible to receive catastrophic leave, (Appendix M) pursuant to the following: 9.10.1.1 Definition: a catastrophic illness or injury that is expected to incapacitate the unit member, or a member of their family, for an extended period of time. It also requires that the unit member needs to take time off from work to care for themselves or the family member, and that taking time off work creates a financial hardship. 9.10.1.2 MEA is responsible for administering and awarding leaves from the Catastrophic Leave Bank. The MEA committee will recommend to the MEA Executive Board, and the Executive Board will determine to approve or deny the request. The MEA secretary will notify the District in writing of any days applied against the Catastrophic Leave Bank (see Appendix M).
