Catastrophic Leave Bank. When the number of days in the bank falls below fifty (50) days, a request for donations to the bank will be sent to all unit members.
Catastrophic Leave Bank. The City agrees to establish a Catastrophic Leave Bank to assist employees who have exhausted accrued leave time due to a serious or catastrophic illness or injury. The Catastrophic Leave Bank (CLB) will allow the bargaining unit employees to donate time to affected employees within and outside the unit, so that he/she can remain in a paid status for a longer period of time, thus partially ameliorating the financial impact of the illness, injury or condition. This donated time will be placed in a CLB and drawn down from the CLB by the eligible employee. Eligibility To be eligible for this benefit, the receiving employee must: 1) Be a regular full time employee, 2) Have sustained or have an immediate family member who has sustained a life threatening or debilitating illness, injury or condition which may require confirmation by a physician, 3) Have exhausted all accumulated paid leave including vacation, holiday, sick leave, and/or compensatory time off, 4) Be unable to return to work for at least 30 days or in the case of the condition affecting the immediate family member, that member must be in need of prolonged and significant personal care; and 5) Conformed with the requirements of the Family Medical Leave Act and/or Worker's Compensation.

Catastrophic Leave Bank. 15 The intent of the Catastrophic Leave Bank (CLB) is to provide support for any active unit member 16 when a member of their family suffers from a catastrophic illness or injury. “Catastrophic illness" or 17 "injury" is a life-threatening or critical event which incapacitates a family member and requires the 18 unit member to take time off from work. 19 11.12.1 For the purpose of this article, “family member" is defined as spouse, domestic 20 partner, child, step child, ▇▇▇▇▇▇ child, parent or stepparent. 21 11.12.2 The unit member must have exhausted all qualifying paid leave in order to draw 22 from the CLB. 23 11.12.3 All bargaining unit members may become members of the CLB by voluntarily 24 contributing one (1) Personal illness/Personal Necessity day for the establishment and 25 maintenance of the Bank. Only contributors will be allowed to withdraw from the CLB. All 26 donations of eligible leave credits are irrevocable. 27 11.12.3.1 Contributions to the CLB may be made during the District's certificated benefit 1 open enrollment period. The Association will notify unit members of the open 2 enrollment period and the District will provide a CLB Membership Enrollment form 3 for unit members. 4 11.12.3.2 Employees who elect NOT to join the CLB during the open enrollment period or 5 within 30 days of being hired, will become eligible for membership in the following 6 open enrollment period. 7 11.12.3.3 Unit members must have a minimum of nine (9) days of Personal illness leave after 8 contribution of one (1) day has taken place. 9 11.12.3.4 At the beginning of a school year, newly hired unit members or unit members 10 returning from a leave of absence shall be granted a thirty (30) day window in 11 which to contribute a day to the CLB. 12 11.12.3.5 Cancellation occurs automatically whenever a unit member fails to make their 13 necessary contribution during the open enrollment period or during the annual 14 assessment. The unit member will not be able to withdraw from the CLB as of the 15 effective date of cancellation. 16 11.12.4 Days in the CLB will accumulate from year to year, up to four hundred (400) days. 17 11.12.4.1 During an open enrollment period where the CLB's total days are four 18 hundred (400) days, the CLB yearly contributions shall be suspended until which 19 time the next enrollment period falls below four hundred (400) days. Catastrophic Leave Bank. 1. The Catastrophic Leave Bank shall be available only for participating member of the bank. The purpose of the Catastrophic Leave Bank is to provide paid leave to bargaining unit members who have experienced a catastrophic illness or injury either personally or within their family. A qualifying “catastrophic illness” or “injury” means an illness or injury that is expected to incapacitate the employee for an extended period of time, or that incapacitates a member of the employee’s family, requiring the employee to take time off from work for an extended period of time to care for that family member. An employee’s industrial injury or industrial leave does not qualify as an illness or injury under this definition, provided the employee is eligible for coverage under Workers’ Compensation. 2. All new employees will automatically become members of the bank unless within 60 days of employment they notify the District in writing that they do not wish to join. Current bargaining unit members will be given the opportunity within 60 days of the adoption of this language to withdraw from membership in the bank. Thereafter everyone who wishes to continue to be eligible must participate in each subsequent contribution. Bargaining unit members may in writing opt out of coverage with 30 days following each subsequent requirement for contributions of one (1) additional sick day for the bank. When a member opts out he/she forfeits the right to request Catastrophic Leave benefits under this Section. 3. A maximum of sixty days may be granted to a unit member when accrued paid sick leave is exhausted. This period is normally before the unit member has sought or qualified for “differential days.” All catastrophic leaves grants must be preceded by a written request describing the catastrophic illness or injury and how the bargaining unit member qualifies for the Leave as defined in Paragraph I above. Initially the Assistant Superintendent of Human Resources and the SLTA President shall evaluate act upon the request. If they are in agreement, their decision shall be final. In the event they are not in agreement after consideration of the request, the Association and the District shall appoint a mediator/arbitrator to facilitate an agreement. If such agreement is not forthcoming, the mediator/arbitrator shall make a final binding decision regarding the request for Catastrophic Leave. Catastrophic Leave Bank. A. Rules and Procedures for the Miami-Dade Schools Police Department (M-DSPD) Catastrophic Sick Leave Bank of the Florida State Lodge, Fraternal Order of Police (herein after referred to as the “Union″) agrees to staff and operate a Catastrophic Sick Leave Bank Committee for the term of this Contract. The committee is to be selected by majority vote of the Union members in the bargaining unit. It shall be the responsibility of this Committee to administer the M-DSPD’s Catastrophic Sick Leave Bank Rules and Procedures stipulated below: 1. Miami-Dade County Public Schools (M-DCPS) agrees to: a. assist the committee in the operation of the M-DSPD’s Catastrophic Sick Leave Bank by providing, upon request, data from participating employeessick leave records. These data will be used to plan the initial operation of the bank and as a basis for Catastrophic Sick Leave Bank withdrawals; and b. designate an administrator to meet periodically with the M-DSPD’s Catastrophic Sick Leave Bank Committee and to act as liaison with the appropriate M-DCPS office. 2. The M-DSPD’s Catastrophic Sick Leave Bank Committee shall: a. maintain adequate records relative to all functions of the bank; b. meet periodically with a designated administrator of M-DCPS to review M-DSPD’s Catastrophic Sick Leave Bank records; and c. operate the M-DSPD’s Catastrophic Sick Leave Bank in accordance with the rules and procedures contained herein. M-DCPS shall establish and the Union shall comply with procedures for identifying and recording contributions to the bank and for complying with any applicable governmental regulation of sick leave or sick leave banks or associated record keeping. B. Purpose 1. To provide employees with an emergency pool of sick leave days for illness, accident, or injury of self above and beyond those available under the “Sick Leave With Pay″ provision (Article XX), the Board and Union hereby establish the M-DSPD’s Catastrophic Sick Leave Bank. 2. The M-DSPD’s Catastrophic Sick Leave Bank shall function under rules and procedures administered by the Union. All eligible full-time employees in the M-DSPD unit may participate in the M-DSPD’s Catastrophic Sick Leave Bank. 3. Catastrophic Leave Bank. The District shall establish a Catastrophic Leave Bank to which eligible unit members may donate earned and unused sick and/or vacation leave. Unit members who wish to donate may do so by completing the “Catastrophic Leave Donation Form” and returning it by the posted deadline. Donations are confidential, irrevocable, and cannot be rescinded for any reason whatsoever. A donation to the Catastrophic Leave Bank shall be a general donation and shall not be donated to a specific unit member for exclusive use. The maximum number of hours which may be accumulated in the Catastrophic Leave Bank is 1,280 hours (160 days).

The Catastrophic Leave Bank shall not be initiated until the employee’s leave balances (annual leave, floating holidays, and comp time bank) are completely exhausted. In order to be eligible to receive paid leave from the Catastrophic Leave Bank due to an employee’s own health condition, an employee must provide a physician’s statement that the employee’s health condition is such that the employee is currently unable to perform his/her regular duties and that provides an estimate of the length of time the employee’s health condition will be such that the employee is unable to perform his/her regular duties. If an employee is eligible for FMLA, the employee must apply FMLA leave while using the Catastrophic leave bank. In order to be eligible to receive paid leave from the Catastrophic Leave Bank due to the health condition of a member of an employee’s immediate family, an employee must provide a physician’s statement that the health condition of the member of the employee’s immediate family is such that the employee must take time off from work to provide care for that person and an estimate of the length of time the employee will need to take time off from work to provide such care. If an employee is eligible for FMLA, the employee must apply FMLA leave while using the Catastrophic leave bank.
