POSTING OF REHEARSAL AND PERFORMANCE SCHEDULES. (a) A call board shall be provided in each place where rehearsals are regularly scheduled, and all notices concerning rehearsals shall be posted thereon. (b) The EMPLOYER shall make best efforts to post a detailed rehearsal schedule indicating each ARTIST's schedule by 12 noon two (2) working days in advance of the rehearsal, but in any event not later than 12 noon one (1) working day in advance of the rehearsal. (c) If the EMPLOYER does not abide by the foregoing (a) and (b) above, or any part thereof, the ARTIST shall be exonerated for any lateness or missing of rehearsals occasioned thereby (d) The program of dance pieces, including casts, to be performed in the following week shall be posted on the bulletin board one (1) week in advance. Any change in casts following such posting shall be made by the EMPLOYER upon personal notification to each ARTIST involved twenty-four (24) hours in advance of performance, except in the case of emergency. (e) The EMPLOYER shall have listed in the program distributed to the audience, or on a reader board in the main lobby, or have announced to the audience, the names of all ARTISTS who perform leading roles, as designated by the Artistic Director. (f) In the event changes (other than corps dance roles) occur in the cast, a program insert or readerboard, or announcement (unless specifically not requested by the ARTIST) shall be made to the audience. (g) The EMPLOYER shall use best efforts to notify the ARTISTS by telephone or in person within one-half (1/2) hour after curtain down on a performance day, Technical or Dress Rehearsal day and prior to 9:00 PM on a rehearsal day of any changes in the rehearsal schedule for the following day affecting the arrival time of the ARTIST. ARTISTS shall be exonerated for any lateness or missing rehearsals unless such notification shall occur. (h) The EMPLOYER shall use best efforts to ensure that anyone designated as a performer or cover is notified of his or her part or cover designation during the first week of rehearsal of that dance piece.

Any change in casts following such the cast posting specified in (a), above, shall be made by the EMPLOYER upon personal notification to each ARTIST involved twenty-four (24) hours in advance of performance, except in the case of emergency. d) For new dance pieces or dance pieces that have not been performed by the Company during the last three (3) years, schedules may be posted as follows: (i) On Monday, Tuesday's individual ARTIST's schedule shall be posted not later than 3:15 p.m. and Wednesday's individual ARTIST schedule shall be posted by the end of the work day; (ii) On Tuesday, Thursday's individual ARTIST's schedule shall be posted not later than 3:15 p.m.. If the ARTIST is dismissed from a scheduled rehearsal in progress, the actual time rehearsed shall be counted in one half (h1/2) hour increments. F. The EMPLOYER ARTIST shall use best efforts be required to ensure report to the theater one half (1/2) hour prior to the advertised curtain time for each scheduled performance. It is understood and agreed that anyone designated as a performer or cover is notified of the ARTIST’s employment, once the ARTIST has commenced his or her part or cover designation during employment, is continuous and consecutive, with the first week exception of rehearsal lay offs. The foregoing notwithstanding, however, EMPLOYER shall have the right to close the Production by giving each ARTIST not less than one (1) week’s written notice. The ARTIST’s individual contract of that dance pieceemployment shall be deemed to be terminated as of the closing date of the Production.

Complete program and casting shall be posted by 12:00 noon ten (10) working days prior to each performance. For each day a violation occurs, the EMPLOYER will contribute $100 to the Dancers' Fund. Any change in casts following such posting shall be made by the EMPLOYER upon personal notification to each ARTIST involved twenty-four (24) hours in advance of performance except in the case of emergency. Notwithstanding the above, the EMPLOYER may post a full company call for up to three (3) days for the setting or casting of ballets under the following conditions: (i) A choreographer or choreographer's designate is present and is creating or setting a new work, a work new to the Company, or a work which has not been performed by the Company in the past three (3) years; or (ii) A choreographer or choreographer's designate is present, who has never worked with the Company or has not worked with the Company in the past three (3) years, and is setting a work which has been performed by the Company in the past. (c) If the EMPLOYER does not abide by the foregoing (a) and (b) above, or any part thereof, the ARTIST shall be exonerated for any lateness or missing of rehearsals occasioned thereby. (d) The program of dance pieces, including casts, to be performed in the following week shall be posted on the bulletin board one (1) week in advance. Any change in casts following such posting shall be made by the EMPLOYER upon personal notification to each ARTIST involved twenty-four (24) hours in advance of performance, except in the case of emergency. (e) The EMPLOYER shall have listed in the program distributed to the audience, or on a reader board in the main lobby, or have announced to the audience, the names of all ARTISTS who perform leading roles, as designated by the Artistic Director. If EMPLOYER fails to comply, ARTIST shall be compensated $50.00. (gf) Changes in the posted daily schedule may be made for rehearsal of six (6) or fewer ARTISTS without incurring a penalty when such change is the result of the absence of an ARTIST due to illness, injury, unexcused absence or severe weather conditions. Such change in schedule shall be permitted so long as the content of the rehearsal remains the same. The EMPLOYER shall use best efforts attempt to notify the affected ARTISTS by telephone or in person within one-half (1/2) hour after curtain down on a performance day, Technical or Dress Rehearsal day and prior to 9:00 PM on a rehearsal day of any changes in the rehearsal schedule for the following day affecting the arrival time of the ARTIST(i) in person, or (ii) by telephone to their last known phone number. ARTISTS An ARTIST shall be exonerated for any lateness or missing rehearsals absence from a scheduled activity unless such notification shall occuris given. If a Company class is to be conducted by an outside choreographer (or his/her designee) or outside xxxxxx it shall use best efforts be scheduled as rehearsal and limited to ensure that anyone designated as a performer or cover is notified of his or her part or cover designation during the first week of rehearsal of that dance piecethree (3) times per week.

(c) If the EMPLOYER does not abide by the foregoing (a) and (b) above, or any part thereof, the ARTIST shall be exonerated for any lateness or missing of rehearsals occasioned thereby. In the event of a world premiere, the cast for said premiere/ballet will be posted by no later than the end of the third (e3rd) day of the first rehearsal week. For all other works, the basic cast and understudies shall be posted six (6) workdays after commencing rehearsals for a work during the current season. f. In the event of a world premiere, the individual Artist’s schedule must be posted not later than 3:00 p.m. of the third (3rd) day of the first rehearsal week of said premiere. g. The EMPLOYER Employer shall have listed in the program distributed to the audience, or on a reader board in the main lobby, or have announced to the audience, the names of all ARTISTS Artists who perform leading roles, as designated by the Artistic Director. Nutcracker Tour Schedule - The entire Nutcracker tour schedule shall be made available to all Artists at the audienceearliest possible time, but in no event later than two (2) weeks prior to departure. The schedule shall include all pertinent information, i.e., casting, itinerary, hotels, performance times, etc. (g) i. The EMPLOYER Employer shall use best efforts to notify provide the ARTISTS by telephone or in person within one-half (1/2) hour after curtain down on Artists with a schedule of performance day, Technical or Dress Rehearsal day and prior to 9:00 PM on a rehearsal day of any changes in the rehearsal schedule weeks for the following day affecting season by the arrival time end of each season. The Employer shall provide the ARTISTArtists a schedule of lay-off weeks for the season at the beginning of each season. ARTISTS Both schedules are subject to change with twelve (12) weeks’ notice, and the Employer shall promptly notify Artists as soon as changes are made. j. At least three (3) times during the season there shall be exonerated for any lateness or missing rehearsals unless such notification shall occura meeting between the full Company, the Artistic Director, and the Executive Director. The meetings will be scheduled during scheduled rehearsal hours. (h) The EMPLOYER k.
