Common use of Posting Requirements Clause in Contracts

Posting Requirements. Owner shall post the Performance Assurance in accordance with the following terms and conditions: (i) Owner shall post all of the Performance Assurance on or before the Commercial Operation Date; (ii) Performance Assurance must be in the form of cash or a Letter of Credit; and (iii) The Performance Assurance and any interest accrued thereon in accordance with Section 7.3(a) shall be held by CHGE as security for Owner’s performance of its obligations under this Agreement during the remainder of the Term.

Owner shall post the Performance Assurance in accordance with the following terms and conditions:conditions:‌ (i) Owner shall post all of the Performance Assurance on or before the Commercial Operation Date; (ii) Performance Assurance must be in the form of cash or a Letter of Credit; and (iii) The Performance Assurance and any interest accrued thereon in accordance with Section 7.3(a7.03(a) shall be held by CHGE O&R as security for Owner’s performance of its obligations under this Agreement during the remainder of the Term.
