Powers and Duties of Arbitrator. 8(1) Without limiting the generality of any other rule which confers jurisdiction or powers on the Arbitrator, and unless the parties at any time agree otherwise, the Arbitrator may: order an adjournment of the proceedings from time to time; make a partial award; make an interim order or award on any matter with respect to which it may make a final award; order inspection of documents, exhibits or other property, including a view or physical inspection of property; at any time extend or abridge a period of time fixed or determined by it, or any period of time required in these Rules; make interim and other orders, including settling of matters at the pre-hearing meeting, that do not deal with the issues in Dispute; and order that any party or witness shall be examined on oath or affirmation, and may for that purpose administer any necessary oath or take any necessary affirmation.
Powers and Duties of Arbitrator. 10 (a) An arbitrator shall conduct an arbitration in a manner the arbitrator considers 11 appropriate for a fair and expeditious disposition and, unless otherwise agreed by the parties, 12 select the rules for conducting the arbitration.
Powers and Duties of Arbitrator. The arbitrator shall have the power to grant declaratory or equitable relief only and shall not have the power to award damages. The arbitrator shall prepare and provide to the parties a written decision on all matters subject to the arbitration, including factual findings and the reasons that form the basis of the arbitrators decision. The arbitrator shall not have the power to commit errors of law or legal reasoning, and the decision of the arbitrator shall be vacated or corrected for any such error or on any other grounds specified in Code of Civil Procedure section 1286.2 or section 1286.6. The decision of the arbitrator shall be mailed to the parties no later than thirty (30) days after the close of the arbitration hearing. The arbitration proceedings shall be reported by a certified shorthand court reporter. Written transcripts of the proceedings shall be prepared and made available to the parties.

  • Powers and Duties of the President Subject to the powers of the Chairman, if there be such an officer, the President shall be the principal executive officer of the Trust.
