Preferred Hours. The employer will have regard to the impact of working hours on the personal circumstances, study requirements and family requirements of employees when arranging the roster. Where an employee makes a request to regular work at preferred times that are suited to the employee, that have neither been arranged or requested by the employer, the employer may agree to offer such preferred hours of work. In order for preferred hours to be worked: i. The employee must initiate the request for the preferred hours in writing to the employer for the employer’s consideration; and ii. The employer must agree to the employee working their preferred hours. If the employer accepts the employee’s request for preferred hours of work, the employer may pay the employee for such preferred hours at the ordinary hourly rate. If at any time the employee seeks to revert from their preferred hours to the standard hours in this Agreement then the employee should advise the employer in writing of the requested change. An employee may work their preferred hours without receiving penalty payments up to a maximum of 38 hours per week averaged over a 4 week cycle. Hours in excess of 38 hours per week will be subject to overtime (Clause 4.5) in this Agreement.
