Preservation of Trustee's Rights. The Trustee in its individual capacity shall be entitled to all the rights set forth in this Article with respect to any Senior Indebtedness which may at any time be held by it, to the same extent as any other holder of Senior Indebtedness, and nothing in this Indenture shall deprive the Trustee of any of its rights as such holder. Nothing in this Article XII shall apply to claims of, or payments to, the Trustee under or pursuant to Section 6.6.

The Trustee shall not be deemed to have any fiduciary duty to any holder of Senior Indebtedness. No implied covenant or obligation with respect to any holder of Senior Indebtedness shall be read into this Indenture.

Nothing in Sections 2.16 through 2.30 of this Supplemental Indenture shall apply to claims of, or payments to, the Trustee under or pursuant to the provisions in the Indenture regarding compensation and indemnification of the Trustee.

The Trustee in its individual capacity shall be entitled to all the rights set forth in this Article Thirteen with 172 respect to any Guarantor Senior Debt which may at any time be held by the Trustee, to the same extent as any other holder of such Guarantor Senior Debt, and nothing in this Indenture shall deprive the Trustee of any of its rights as such holder. Nothing in this Article Thirteen shall apply to claims of, or payments to, the Trustee under or pursuant to Section 6.07, none of which is or shall be subordinate in right of payment to Guarantor Senior Debt or Senior Debt.
