Common use of Prevention of Fraud Clause in Contracts

Prevention of Fraud. 13.1 The Supplier shall take all reasonable steps, in accordance with Good Industry Practice, to prevent any Fraud by the Supplier and any member of the Supplier’s Staff. 13.2 The Supplier shall notify the Customer immediately if it has reason to suspect that any Fraud has occurred or is occurring or is likely to occur save where complying with this provision would cause the Supplier or any member of the Supplier’s Staff to commit an offence under the Proceeds of Crime Act 2002 or the Terrorism Act 2000. 13.3 If: 13.3.1 the Supplier breaches any of its obligations under Clause 13.1 and Clause 13.2; or 13.3.2 the Supplier or any member of the Supplier’s Staff commits any Fraud in relation to the Contract or any other contract with the Customer or any other person, the Customer may recover in full from the Supplier and the Supplier shall on demand indemnify the Customer in full against any and all losses sustained by the Customer in consequence of the relevant breach or commission of Fraud, including the cost reasonably incurred by the Customer of making other arrangements for the supply of the Contract Services and any additional expenditure incurred by the Customer in relation thereto.
