Common use of Prevention of Fraud Clause in Contracts

Prevention of Fraud. 28.1 The Supplier shall take all reasonable steps, in accordance with Good Industry Practice, to prevent any Fraud by Staff and the Supplier (including its shareholders (holding in excess of 50% of the entire issued share capital of the Supplier), members and directors) in connection with the receipt of monies from the Customer. 28.2 To the extent permitted by Law, the Supplier shall notify the Customer and/or any appropriate Regulatory Body immediately if it has reason to suspect that any Fraud has occurred or is occurring or is likely to occur. 28.3 If the Supplier or its Staff commits any Fraud in relation to this or any other contract with a Contracting Authority or the Customer, the Customer may: 28.3.1 terminate the Contract with immediate effect by giving the Supplier notice in writing and recover from the Supplier the amount of any loss suffered by the Customer resulting from the termination including the cost reasonably incurred by the Customer of making other arrangements for the supply of the Placement Services and any additional expenditure incurred by the Customer throughout the remainder of the Contract Period; and/or 28.3.2 recover in full from the Supplier any other loss sustained by the Customer in consequence of any breach of this clause. 28.4 If the Contractor commits any Fraud in relation to the provision of the Contractor Services, the Supplier acknowledges and agrees that the Customer may terminate the Contract with immediate effect by giving the Supplier notice in writing.

Prevention of Fraud. 28.1 33.1 The Supplier shall take all reasonable steps, in accordance with Good Industry Practice, to prevent any Fraud by Staff and the Supplier (including its shareholders (holding in excess of 50% of the entire issued share capital of the Supplier)shareholders, members and directors) in connection with the receipt of monies from the Customer. 28.2 To the extent permitted by Law, the 33.2 The Supplier shall notify the Customer and/or any appropriate Regulatory Body immediately if it has reason to suspect that any Fraud has occurred or is occurring or is likely to occuroccur save where complying with this provision would cause the Supplier or its Staff to commit an offence under the Proceeds of Crime Act 2002 or the Terrorism Act 2000. 28.3 33.3 If the Supplier or its Staff commits any Fraud in relation to this or any other contract with a Contracting Authority or the Customer, the Customer may: 28.3.1 33.3.1 terminate the Contract with immediate effect by giving the Supplier notice in writing and writing; and/or 33.3.2 recover in full from the Supplier and the amount of Supplier shall on demand indemnify the Customer in full from any loss suffered sustained by the Customer resulting from the termination including in consequence of any breach of this clause 33including the cost reasonably incurred by the Customer of making other arrangements for the supply of the Placement Goods and Services and any additional expenditure incurred by the Customer throughout the remainder of the Contract Period; and/or 28.3.2 recover in full from the Supplier any other loss sustained by the Customer in consequence of any breach of this clause. 28.4 If the Contractor commits any Fraud in relation to the provision of the Contractor Services, the Supplier acknowledges and agrees that the Customer may terminate the Contract with immediate effect by giving the Supplier notice in writing.

Prevention of Fraud. 28.1 27.1 The Supplier Service Provider shall take all reasonable steps, in accordance with Good Industry Practice, to prevent any Fraud by Staff and the Supplier Service Provider (including its shareholders (holding in excess of 50% of the entire issued share capital of the Supplier)shareholders, members and directors) in connection with the receipt of monies from the Customer. 28.2 To the extent permitted by Law, the Supplier 27.2 The Service Provider shall notify the Customer and/or any appropriate Regulatory Body immediately if it has reason to suspect that any Fraud has occurred or is occurring or is likely to occuroccur save where complying with this provision would cause the Service Provider or its Staff to commit an offence under the Proceeds of Crime Act 2002 or the Terrorism Act 2000. 28.3 27.3 If the Supplier Service Provider or its Staff commits any Fraud in relation to this or any other contract with a Contracting Authority or the Customer, the Customer may: 28.3.1 27.3.1 terminate the Contract with immediate effect by giving the Supplier Service Provider notice in writing and writing; and/or 27.3.2 recover in full from the Supplier Service Provider and the amount of Service Provider shall on demand indemnify the Customer in full from any loss suffered sustained by the Customer resulting from the termination in consequence of any breach of this clause 27 including the cost reasonably incurred by the Customer of making other arrangements for the supply of the Placement Goods and/or Services and any additional expenditure incurred by the Customer throughout the remainder of the Contract Period; and/or 28.3.2 recover in full from the Supplier any other loss sustained by the Customer in consequence of any breach of this clauseTerm. 28.4 If the Contractor commits any Fraud in relation to the provision of the Contractor Services, the Supplier acknowledges and agrees that the Customer may terminate the Contract with immediate effect by giving the Supplier notice in writing.
