Prevention of programme scans and recordings. The simulcaster must use generally commercially available and effective technical measures which serve the purpose of preventing that a) the person receiving a transmission or any other person can automatically scan the simulcaster's pro- gramme itself or together with the transmissions by other simulcasters in order to filter out specific music recordings from the programmes; b) the person receiving a transmission can create copies of the music recordings (except thereof are xxxx- xxxxx copies made for technical reasons) and c) third parties can create video-on-demand services on the basis of the simulcast.
