That is perhaps not surprising: although Article II(2) implied that principal liability was limited to those who personally committed the actus reus of a crime, it specifically provided that any defendant whose actions fell within the parameters of Article II(2) was “deemed to have committed” a war crime, crime against humanity, or crime against peace. The principal/accessory distinction was thus generally irrelevant, although one tribunal held that the modes of participation enumerated in Article II(2) were listed in descending order of culpability, an issue discussed in Chapter 14.
