Procedure Generally. The parties agree to submit the Dispute to a single arbitrator selected from a panel of JAMS arbitrators. The arbitration will be governed by the JAMS Comprehensive Arbitration Rules and Procedures in effect at the time the arbitration is commenced, subject to the terms and modifications of this Agreement. If for any reason JAMS cannot serve as the arbitration administrator or cannot fulfill the panel requirements of the Arbitration Provision, the Company may select an alternative arbitration administrator, such as AAA, to serve under the terms of this Agreement.

Nothing in this procedure shall prohibit an employee from informally attempting to resolve a dispute during the open five (5) day period prior to the initiation of a formal grievance. Procedure Generally. Nothing in this article shall be interpreted as discouraging or prohibiting informal discussions of a dispute prior to the filing of the grievance. A grievance shall be started by the employee or the union representative starting at Step 1. Grievances must be started within fourteen (14) calendar days following the occurrence giving rise to the dispute. Discipline grievance shall be filed by the union or the employee within seven (7) calendar days of receipt of the notice of discipline by the disciplined employee at Step 2 of the Grievance Procedure. All grievances must be filed and processed at the proper steps of the procedure to be valid. It is acknowledged by the parties that this is a final and binding grievance procedure as defined in Ohio Revised Code, Section 4117.10 and that specific provisions of this Agreement are to be resolved through the procedures set out in Section 4117.10.

Any grievance that is not timely appealed to the next step of the procedure will be deemed to have been settled on the basis of the Employer’s answer at the last completed step. Time limits set forth herein may only be extended by mutual agreement of the parties. The aggrieved may withdraw a grievance at any point by submitting, in writing, a statement to that effect, or by permitting the time requirements at any step to lapse without further appeal.
