Process Equipment. The Xxx Xxxxxxx Company, Cimbria Sket and Westfalia will provide the process equipment. The Xxx Xxxxxxx Company will erect all equipment in the process structure. Piping of the process equipment and utilities, instrumentation mounting and wiring will be the responsibility of the Xxxxx Group of Des Moines, IA, a strategic partner of The Xxx Xxxxxxx Company. Tanks located in the tank farms will be provided and installed by The Xxx Xxxxxxx Company. These tanks will include appropriate foundations, piping, pipe insulation, tank insulation and painting as required. Tanks will be constructed of stainless steel and carbon steel to meet API 650 Code. Non-insulated stainless steel tanks will not be painted. Tanks that are heated will also be insulated. Pipe racks will be furnished as required from the rail loading and un-loading to the tank farm and from the tank farm into the process building. Pipe racks will also service the truck loading and unloading area as required and pipe racks will be sized for future four (4) 6” lines. The Xxx Xxxxxxx Company will construct the tank farm containment for the tanks. Containment will include the earthen berms, the containment walls, stabilized containment floors, finished surface gravel inside the containment dikes and final grading after erection of the field built tanks. One end of the containment dike will be left open to grade for access to construct the field build tanks. Tank foundations (by The Xxx Xxxxxxx Company) will be constructed after the tank farm containment is completed. All pressure vessels will be constructed to meet ASME as a minimum. Some vessels will be constructed in Germany per comparable German code and the ASME code. All equipment and construction will have a minimum of a one-year mechanical warranty in force. Process piping will be specified, procured, installed and tested per ANSI B31-1 or ANSI B31-3 codes.

Process Equipment. Tenant elected to have Landlord install the ----------------- Process Equipment pursuant to Section 2(d)(iv) of the Original Lease. Landlord confirms that it has received full payment in respect of the Process Equipment, and no Rent or other payments are due from Tenant in respect thereof. The Process Equipment shall be the property of Tenant and subject to the provisions of Section 7(c) of the Original Lease.
Process Equipment. (i) Landlord and Tenant acknowledge that the machinery and equipment described on Exhibit "D" attached hereto and by this reference made a part hereof (the "Process Equipment") has been designed and manufactured at Tenant's request and is essential to the conduct and performance of Tenant's business to be conducted on the Premises. Landlord and Tenant understand and agree that, subject to the provisions of subparagraph 2(d)(iv) hereof, Tenant shall be solely responsible for installing the Process Equipment in the Building pursuant to the working drawings and blueprints listed on Exhibit "E" attached hereto and by this reference made a part hereof (the "Process Equipment Plans"). (ii) Pursuant to the Development Schedule, the installation of the Process Equipment is not designated a Key Task or Benchmark Task. Landlord and Tenant understand and agree, however, that in the event Tenant elects to have Landlord install the Process Equipment, the failure to install the Process Equipment by the date designated on the Development Schedule shall allow Tenant to avail itself of the options and remedies to which it would otherwise be entitled due to the failure to complete a Key Task by a Key Date, provided such delay is not caused by any of the reasons specified in subparagraph 2(c) hereof. (iii) Upon receipt of Tenant's written notice, Landlord will allow Tenant reasonable access to the Premises to install and test the Process Equipment, provided Tenant first complies with the insurance provisions applicable to Tenant's early entry set forth in Paragraph 9 hereof and provided further that Tenant shall pay Landlord, in addition to the rent otherwise payable hereunder, a monthly sum for such early entry (the "Early Entry Rent") equal to one-half (1/2) of the difference between the monthly rent payable for the entire Premises during the first twelve (12) months following the Occupancy Date (as hereinafter defined) and the monthly Warehouse Rent (as hereinafter defined). The Early Entry shall commence upon the later of the Commencement Date or ten (10) days following the notice provided for in the first sentence of this subparagraph 2(d)(iii) and shall be paid as provided for payment of Rent; provided, however, that Tenant shall only be obligated to pay Early Entry Rent for the period of time between the date of Tenant's Early Entry and the Occupancy Date.   • Contractor’s Equipment Payment for required equipment owned by the Construction Manager or an affiliate of the Construction Manager will be based solely on an hourly rate derived by dividing the current appropriate monthly rate by 176 hours. No payment will be made under any circumstances for repair costs, freight and transportation charges, fuel, lubricants, insurance, any other costs and expenses, or overhead and profit. Payment for such equipment made idle by delays attributable to the Government will be based on one-half the derived hourly rate under this subsection.

  • Customer Equipment Customer represents and warrants that it owns or has the legal right and authority, and will continue to own or maintain the legal right and authority during the term of this Agreement, to place and use the Customer Equipment as contemplated by this Agreement. Customer further represents and warrants that its placement, arrangement, and use of the Customer Equipment in the Internet Data Centers complies with the Customer Equipment Manufacturer's environmental and other specifications.

  • Metering Equipment 13.01. Utility will furnish, install, own and maintain metering equipment capable of measuring the flow of kilowatt-hours (kWh) of energy. The Customer's service associated with the CRG will be metered at a single metering point. The metering equipment will measure energy delivered by Utility to Customer and also measure energy delivered by Customer to Utility. Customer agrees to provide safe and reasonable access to the premises for installation of this equipment and its future maintenance or removal.

  • New Equipment Where new types of equipment and/or operations, for which rates of pay are not established by this Agreement, are put into use after the ratification date of this Agreement within operations covered by this Agreement, rates governing such operations shall be subject to negotiations between the parties.   • Equipment Use Lessee agrees that the Equipment will be operated by competent, qualified personnel in connection with Lessee's business for the purpose for which the Equipment was designed and in accordance with applicable operating instructions, laws, and government regulations, and that Lessee shall use all reasonable precautions to prevent loss or damage to the Equipment from fire and other hazards. Lessee shall procure and maintain in effect all orders, licenses, certificates, permits, approvals, and consents required by federal, state, or local laws or by any governmental body, agency, or authority in connection with the delivery, installation, use, and operation of the Equipment.

  • Tooling Unless otherwise specified in this Agreement, all tooling and/or all other articles required for the performance hereof shall be furnished by Seller, maintained in good condition and replaced when necessary at Seller's expense. If NETAPP agrees to pay Seller for special tooling or other items either separately or as a stated part of the unit price of Goods purchased herein, title to same shall be and remain in NETAPP upon payment therefore.
