Processing of Sales; Fulfillment. The Jet Marketplace will determine when one of your products is sold to Jet on the terms set forth in this Agreement, at which time Jet will notify you of the transaction by providing you the order and shipping information to ship your product to the Jet Customer. All transactions will be in U.S. Dollars (US$). If you sell consumable products (e.g. paper towels, deodorant, dog food, etc.), you must be capable of delivering your products to Jet Customers within two (2) business days or those products typically will not be selected for fulfillment. You agree to pack, fulfill, ship and deliver each product order on the Jet Marketplace in compliance with the Jet Fulfillment Policy. Jet may use all order, shipping and tracking information to interact with Jet Customers. Jet will serve as the first point of customer service for Jet Customers, and Retail Partners will not communicate with Jet Customers regarding shipments of products by you unless explicitly authorized by Jet. Retail Partners deliver products to Jet Customers and have control over the sales transactions of their products to end users (Jet Customers). Under no circumstances is Xxx making an individual sale to an end user of the products sold without the Retail Partner’s consent. The Retail Partner can elect to not allow Jet to make a sale to any Jet Customer in all circumstances. As part of the order fulfillment process, Retail Partners make a flash sale to Jet and Jet immediately sells the product to the end user. Jet never marks up the product as part of this flash sale. Xxx is the seller of record and Xxx will collect sales tax and remit collected taxes to taxing authorities. This approach is intended to simplify sales tax calculation and processing for both Jet Customers and Retail Partners.

  • Processing of Data You acknowledge and agree that with each use of the Service initiated by your xxxxxxxxxx.xxx authenticated Users the Service will access Your xxxxxxxxxx.xxx account to retrieve, store, manipulate, process and modify Customer Data based on Your configuration of the Service (“Process”) and You expressly consent to such access solely as is necessary to provide the Service or Support Services. If the Service cannot for any reason access Your xxxxxxxxxx.xxx account, Conga will be excused from any nonperformance of the Service. You acknowledge that to provide the Service, Customer Data leaves the xxxxxxxxxx.xxx system. Xxxxxxxxxx.xxx is not responsible for Customer Data when it is outside of the xxxxxxxxxx.xxx system.

  • Processing of Grievance It is recognized and accepted by the Union and the County that the processing of grievances as hereinafter provided is limited by the job duties and responsibilities of the employees and shall therefore be accomplished during normal working hours only when consistent with such employee duties and responsibilities. The aggrieved employee's representative, if an employee, shall be allowed a reasonable amount of time without loss in pay, to investigate a grievance, and present grievances to the County during normal working hours provided the employee and the employee representative have notified the designated supervisor.

  • COLLECTION AND PROCESSING OF ITEMS In processing items You have deposited for collection, We are only Your agent and assume no responsibility beyond the exercise of ordinary care. Any item deposited is subject to final settlement in cash or credit. We may use any method We feel is appropriate to collect items, which may include use of a Federal Reserve Bank. We are not responsible for the acts of any third party We use for the collection of items including responsibility for lost items. If We use a local clearinghouse in the collection of items, You authorize Us to do so and to act in accordance with any applicable rules and regulations. We may permit You to withdraw funds from Your Account before final settlement has been made, however, if final settlement is not made, We have the right to charge Your Account or otherwise require You to repay such funds. In processing items presented for payment on Your Account, We will pay such items each business day in an order of Our choosing, all of which means that the transactions may not be processed in the order in which they occurred and that You could incur multiple fees in a single day should there be insufficient funds to pay all items presented that day.

  • Processing operations The personal data transferred will be subject to the following basic processing activities:

  • BUY AMERICA ACT (National School Lunch Program and Breakfast Program With respect to products purchased by Customers for use in the National School Lunch Program and/or National School Breakfast Program, Contractor shall comply with all federal procurement laws and regulations with respect to such programs, including the Buy American provisions set forth in 7 C.F.R. Part 210.21(d), to the extent applicable. Contractor agrees to provide all certifications required by Customer regarding such programs. In the event Contractor or Contractor’s supplier(s) are unable or unwilling to certify compliance with the Buy American Provision, or the applicability of an exception to the Buy American provision, H-GAC Customers may decide not to purchase from Contractor. Additionally, H-GAC Customers may require country of origin on all products and invoices submitted for payment by Contractor, and Contractor agrees to comply with any such requirement.

  • Processing of a Grievance It is recognized and accepted by the Union and the Employer that the processing of grievances as hereinafter provided is limited by the job duties and responsibilities of the employees and shall therefore be accomplished during normal working hours only when consistent with such employee duties and responsibilities. The aggrieved employee and a Union representative shall be allowed a reasonable amount of time without loss of pay when a grievance is investigated and presented to the Employer during normal working hours provided that the employee and the Union representative have notified and received the approval of the designated supervisor who has determined that such absence is reasonable and would not be detrimental to the work programs of the Employer.

  • Data Processing Agreement The Data Processing Agreement, including the Approved Data Transfer Mechanisms (as defined in the Data Processing Agreement) that apply to your use of the Services and transfer of Personal Data, is incorporated into this Agreement by this reference. Each party will comply with the terms of the Data Processing Agreement and will train its employees on DP Law.

  • ANNUAL MASTER CONTRACT SALES REPORT Contractor shall provide to Enterprise Services a detailed annual Master Contract sales report. Such report shall include, at a minimum: Product description, part number or other Product identifier, per unit quantities sold, and Master Contract price. This report must be provided in an electronic format that can be read by MS Excel.
