Common use of Processing the Grievance at Step 5 Clause in Contracts

Processing the Grievance at Step 5. The parties recognize that each has internal processes through which decisions to arbitrate and/or to pay the costs of arbitration are respectively made. After submission of the grievance to Step 4, the timelines contained in Step 4 shall be held in abeyance for no more than forty-five (45) working days at the request of either party while that party completes its internal processes for arbitration. If one party requests timelines at Step 4 be held in abeyance for this reason, the other party shall use the same time period to complete it internal processes for arbitration. Placement of the grievance in abeyance at Step 4 for these reasons may be extended only with the mutual agreement of both parties.
