Product Sampling and Testing. Product sampling and testing shall be done as stated in the ASC-PCA (Specific) ASC reserves the right to purchase the client’s certified product from the Market and conduct testing to ensure consistent compliance to specified requirements; should a failure occur, the client will be held responsible for the purchase cost and testing cost thereof.

Product Sampling and Testing. 2.12.1 Where the Company uses a subcontracted approved laboratory to test samples taken in association with product certification activities, it is a requirement they have NATA registered (ISO 17025) or equivalent and the Company approved laboratories undertake testing of the products as required under the various programs being certified at the expense of the client. The Company has approved all NATA registered laboratories for use. Samples for these tests shall be taken under controlled conditions as required by the Company. This will normally require the samples to be taken by an independent person agreed by the Company as being competent and independent. Samples shall be sent to the Approved laboratory by means which ensures that the samples are clearly identified and by the most direct means and under the required transport conditions to ensure the accuracy of results are not compromised.

  • Inspections and Testing Each Interconnected Entity shall perform routine inspection and testing of its facilities and equipment in accordance with Good Utility Practice as may be necessary to ensure the continued interconnection of the Customer Facility with the Transmission System in a safe and reliable manner. Each Interconnected Entity shall have the right, upon advance written notice, to request reasonable additional testing of an Interconnected Entity’s facilities for good cause, as may be in accordance with Good Utility Practice.

  • Drug Testing (A) The state and the PBA agree to drug testing of employees in accordance with section 112.0455, F.S., the Drug-Free Workplace Act.

  • Testing Landlord shall have the right to conduct annual tests of the Premises to determine whether any contamination of the Premises or the Project has occurred as a result of Tenant’s use. Tenant shall be required to pay the cost of such annual test of the Premises; provided, however, that if Tenant conducts its own tests of the Premises using third party contractors and test procedures acceptable to Landlord which tests are certified to Landlord, Landlord shall accept such tests in lieu of the annual tests to be paid for by Tenant. In addition, at any time, and from time to time, prior to the expiration or earlier termination of the Term, Landlord shall have the right to conduct appropriate tests of the Premises and the Project to determine if contamination has occurred as a result of Tenant’s use of the Premises. In connection with such testing, upon the request of Landlord, Tenant shall deliver to Landlord or its consultant such non-proprietary information concerning the use of Hazardous Materials in or about the Premises by Tenant or any Tenant Party. If contamination has occurred for which Tenant is liable under this Section 30, Tenant shall pay all costs to conduct such tests. If no such contamination is found, Landlord shall pay the costs of such tests (which shall not constitute an Operating Expense). Landlord shall provide Tenant with a copy of all third party, non-confidential reports and tests of the Premises made by or on behalf of Landlord during the Term without representation or warranty and subject to a confidentiality agreement. Tenant shall, at its sole cost and expense, promptly and satisfactorily remediate any environmental conditions identified by such testing in accordance with all Environmental Requirements. Landlord’s receipt of or satisfaction with any environmental assessment in no way waives any rights which Landlord may have against Tenant.
