Maintenance and Testing. 54.5.1. Sprint is only responsible for maintaining the facilities that it owns.
54.5.2. Sprint will conduct an end-to-end test of Dark Fiber after receipt of the firm order.
54.5.3. For meet point arrangements, Sprint will conduct cooperative testing with another carrier at CLEC’s request. Additional rates and charges will apply.
54.5.4. Sprint does not guarantee that the transmission characteristics of the Dark Fiber will remain unchanged over time.
54.5.5. Sprint is not responsible for determining whether the transmission characteristics of the Dark Fiber will accommodate the CLEC requirements.
Maintenance and Testing. Provider shall install and maintain a utility- grade kilowatt-hour (“kWh”) meter (“Meter”) at the Site where a System is installed for the measurement of Energy provided to Customer at the Site, which shall measure the kWh output of the System on a continuous basis. Upon Customer’s written request, Provider shall furnish a copy of all technical specifications and accuracy calibrations for each Meter, as well as all metering data and energy production calculations. Provider shall test the Meter in compliance with manufacturer’s recommendations and provide the results of such testing to the Customer upon Customer’s request.
Maintenance and Testing. 14.1 Leaseweb reserves the right to suspend the Services and may suspend Customer’s right to access to the Equipment in order to perform Maintenance.
14.2 Customer acknowledges that Leaseweb will from time to time have to perform Maintenance in order to ensure a proper performance of the Network, Data Center and the Services and that such Maintenance may affect the provision of the Services to Customer.
14.3 If Leaseweb expects scheduled Maintenance, referred to in Clause 14.2, to affect the provision of the Services and/or access to the Equipment, Leaseweb shall:
a) to the extent reasonably possible - provide at least three (3) days prior notice to Customer of the intended Maintenance;
b) to the extent reasonably practicable - schedule such Maintenance and any related suspension of the Services and/or access to the Equipment within the Maintenance Window, so as to minimize any adverse effect of the Maintenance on Customer’s use of the Services and/or access to the Equipment; and
c) endeavor to keep the duration of any interruption or suspension or degradation in the provision of the Services and/or Customer’s access to the Equipment as short as possible.
14.4 If Leaseweb does not expect scheduled Maintenance, referred to in Clause 14.2, to affect the provision of the Services and/or access to the Equipment, Leaseweb shall be entitled to perform such Maintenance at any time, without taking into account a notice period.
14.5 Customer acknowledges that Leaseweb may from time to time have to perform non-scheduled Maintenance, in order to resolve or prevent an Emergency. Leaseweb shall be entitled to perform such Maintenance at any time, without taking into account a notice period. Leaseweb shall in such case notify Customer of such Emergency and the need to perform Maintenance without undue delay.
14.6 Customer acknowledges that Leaseweb will from time to time perform Tests and that Tests may be performed at any time, without taking into account a notice period.
Maintenance and Testing. Utility shall install and maintain a utility- grade kilowatt-hour ("kWh") meter ("Meter") on the Site for the measurement of Energy generated by the System at the Site, which shall measure the kWh output of the System on a continuous basis for purposes of determining the Yearly Production. Owner shall be allowed to observe any Meter test, and Utility shall provide notice of the testing to Owner at least ten (10) days prior to the test date. Owner shall reimburse Utility for the cost of the additional tests requested by Owner, unless such testing demonstrates that the Meter was operating outside of industry standard tolerance allowances or an adjustment is required under Section 4.2.2.
Maintenance and Testing. Maintenance shall be performed in accordance with the manufacturer's published maintenance procedures. Periodic testing shall be completed with successful results in accordance with the manufacturer's published recommendations for periodic testing at, or before, the recommended testing intervals. If the manufacturer does not publish recommendations for periodic testing, suitable testing shall be performed that assures proper protection for the Area EPS, at an interval not to exceed two years. All test results shall be documented and available to the Cooperative for review upon request.
Maintenance and Testing. Transmission Owner will provide Interconnection Customer 30 days notice for planned maintenance and testing that will affect the ability of the generator to remain interconnected to the transmission system. For emergency maintenance and testing, the Transmission Owner will provide notice as soon as the Owner is aware of the need for the emergency maintenance and testing. The Interconnection Customer will provide the Transmission Owner 30 days notice of an outage of the Interconnection Customer facilities that will require electrical clearance at the Interconnection Facility. In the event of the need for an emergency outage of the Generator Facilities, the Interconnection Customer will provide the Transmission Owner notice of the need for electrical clearance as soon as the Interconnection Customer is aware of the need for the outage. Nothing in this paragraph prohibits the Transmission Owner or the Interconnection Customer from opening their respective connection facilities without notice in the event of an Emergency Condition.

10.5.6 Rules for Take Back
10.5.6.1 Sprint reserves the right to take back Dark Fiber to meet its carrier of last resort obligations.
10.5.6.2 Sprint will provide CLEC twelve (12) months written notice prior to taking back fiber.
10.5.6.3 If multiple CLECs have leased fiber within a single sheath, Sprint will take back the fiber that was the last to be leased.
10.5.6.4 Sprint will provide the CLEC with alternative transport arrangements when Sprint takes back working fiber.
10.5.6.5 The Dispute Resolution Procedures found in Part B of this Agreement will be followed if CLEC wishes to contest Sprint’s decision to take back its leased fiber.
