Common use of PRODUCTION COST DATA Clause in Contracts

PRODUCTION COST DATA. The PURCHASER understands that the primary objective of the STATE in entering into this Agreement to log the sale area, which is a part of the Xxxxxxx Demonstration State Forest, an experimental forest of the State of California, is to provide a research and demonstration area and to determine the facts and data concerning the timber sale area and the treatment thereof through the actions of the PURCHASER under this Agreement. The PURCHASER agrees to keep records and furnish the STATE production and cost data with respect to activities conducted pursuant to this Agreement. Required data shall include person-hours and equipment-hours spent on each activity, and applicable rates for employees, machines and supervision, and costs for any materials or services needed for completion of activities required by this Agreement. The information shall be reported on a form provided by the STATE (Exhibit A, Attachment 3), or in an alternative format proposed by the PURCHASER and acceptable to the STATE. The requirement for providing production and cost data shall apply equally to any contractors or subcontractors hired by the PURCHASER to complete the project[s] specified above. This information will be furnished to the STATE before the performance bond or other security is released. The PURCHASER understands that the protection of research and experimental values, the maintenance of low fire hazards, the prevention of injury to trees not designated for cutting, the creation of conditions favorable to the regeneration of the State Forest, and other provisions of this Agreement are for fulfillment of the research and demonstration purpose, and the provisions of this Agreement will be strictly enforced to that end.
