PROFESSIONAL DEVELOPMENT AND EDUCATION. 18.01 Nurses, within the spirit of the Public Health Services Learning and Development Policy, shall have the opportunity for learning and development through learning events designed to assist the individual to function in a more efficient and effective manner. The following conditions shall include: (a) Each nurse will be given an opportunity to attend learning event(s) equivalent to a minimum of three (3) calendar days per full time nurses and a pro-rated amount for part time nurses, based on the individual and program needs. Attendance is subject to the approval of the Employer. Payment for all hours in attendance at approved learning events will be at the nurse’s straight time hourly rate. (b) The Employer recognizes that there are certain curriculum courses of study which nurses may take in order to enhance their knowledge and better fit them for employment with the Employer. (d) When a full-time nurse is approved to attend a learning event, on a day the nurse is not scheduled to work, the nurse will be given a substitute scheduled working day off, with pay, to be used within twenty-one (21) calendar days. 18.02 Educational leave for purposes other than outlined in Article 18.01 (a) and (d) shall be granted under the following conditions: (a) such leave shall not exceed eighteen (18) calendar months; (b) leave shall be without pay or benefits; (c) the nurse will retain but not accumulate seniority during this leave; (d) approval shall be granted only by the City Manager or designate on written application by the nurse; (e) extension of such leave may be granted only as approved by the City Manager or designate on written application by nurse three (3) months prior to the expiration of the time limit outlined in (a). Attendance is subject to the approval of the Employer. Payment for all hours in attendance at approved learning events will be at the nurse’s straight time hourly ratefor all educational workshops attended.
(b) The Employer recognizes that there are certain curriculum courses of study instruction which nurses may take in order to enhance their knowledge and better fit them for employment with the Employer. (d) When a full-time nurse is approved to attend a learning eventattends an educational seminar, with permission of the nurse’s Program Manager, on a day the nurse is not scheduled to work, the nurse will be given a substitute scheduled working day off, with off in lieu at some other time without loss of pay, to be used within twenty-one fifteen (2115) calendar working days.
18.02 18.2 Educational leave for purposes other than outlined in Article 18.01 (a) and (d) 19.1 shall be granted under the following conditions:
(a) such leave shall not exceed eighteen (18) calendar months;
(b) leave shall be without pay or benefits;
(c) the nurse will retain but not accumulate seniority during this leave;
(d) approval shall be granted only by the City Manager or designate on written application by the nurse;
(e) extension of such leave may be granted only as approved by the City Manager or designate on written application by nurse three (3) months prior to the expiration of the time limit outlined in (a).
(f) the nurse may continue defined benefits at the nurse’s expense; i.e. life insurance, dental, O.H.I.P., major medical. The City of Xxxxxxxx and the Ontario Nurses' Association agree that nurses (including full-time and part-time) assigned to the School Program may elect to accept a non-paid leave of absence from the third week of June through to Labour Day. The following are the conditions of this agreement:
1. The leave of absence as provided for in this Letter of Understanding may be cancelled by the employee upon reasonable notice being given to the Employer.
2. Nurses electing to take the leave of absence shall apply, in writing, to the Director, or designate by February 1 of each year. Notice of acceptance by the Director, or designate will be received by March 1 of the year in question.
3. It is understood that nurses on this non-paid leave of absence should they elect to be otherwise employed and become injured under WSIB within that employment are not entitled to the benefits of STD as prescribed in the terms of this Collective Agreement.
4. The parties agree that all the terms of the Collective Agreement shall apply, save and except those provisions modified in this letter.
5. The current Collective Agreement shall be amended to specifically reflect this non-paid leave of absence as follows:
(a) Payment for the following paid holidays may be affected and shall be determined by the effective day of the leave of absence: Canada Day (July 1); Civic Day; Labour Day.
