Prohibited Sources of Local Share. Except as permitted by Federal law, regulation, or guidance, or approved in writing by FTA, the Recipient will not provide any local share funds for the Underlying Agreement derived from: (1) Farebox revenues from providing public transportation services using facilities and equipment acquired with funding provided for the Underlying Agreement, (2) Program income derived from the use facilities or equipment acquired with funding for the Project awarded under the Underlying Agreement, except if expressly permitted by Federal law or regulations, or FTA guidance, and (3) Other Federal funds not authorized for use as local share by Federal law, regulation, or guidance,
