Prohibition Against Conditions on Enrollment. (A) The Contractor shall accept eligible Enrollees in the order in which they apply without restrictions (unless such restriction is authorized by CMS), up to the limits set under the Contract. (B) The Parties may not pre-screen or select Potential Enrollees on the basis of pre-existing health problems. (C) The Contractor shall not discriminate against Enrollees or Potential Enrollees on the basis of race, color, national origin, sex, sexual orientation, gender identity, religion, age, or disability, and shall not use any policy or practice that has the effect of discriminating on the basis of race, color, national origin, sex, sexual orientation, gender identity, religion, age, or disability. (D) The Contractor shall not discriminate against Enrollees or against Potential Enrollees on the basis of health status or the need for health services.
