Common use of Prohibition Against Conditions on Enrollment Clause in Contracts

Prohibition Against Conditions on Enrollment. (A) The Contractor shall accept eligible Enrollees in the order in which they apply without restrictions unless such restriction is authorized by the Department, up to the limits set under the Contract. (B) The Contractor shall not discriminate against Enrollees or Potential Enrollees on the basis of race, color, national origin, sex, sexual orientation, gender identity, religion, age, or disability, and shall not use any policy or practice that has the effect of discriminating on the basis of race, color, national origin, sex, sexual orientation, gender identity, religion, age, or disability. (C) The Contractor shall not discriminate against Enrollees or Potential Enrollees on the basis of health status or the need for health services.
