Common use of Prohibition Against Conditions on Enrollment Clause in Contracts

Prohibition Against Conditions on Enrollment. (A) Contractor must accept eligible Enrollees without restrictions unless such restriction is authorized by the Department. (B) Contractor and Department may not pre-screen or select Potential Enrollees on the basis of pre-existing dental problems. (C) Contractor shall not discriminate against Enrollees or Potential Enrollees on the basis of race, color, or national origin, and shall not use any policy or practice that has the effect of discriminating on the basis of race, color, or national origin. (D) Contractor shall not discriminate against Enrollees or against Potential Enrollees on the basis of health status or the need for dental services.
