PROJECT ADMINISTRATIVE COMMITTEE. 8.1 The parties to this CWA hereby recognize the necessity of cooperation and the elimination of disputes, misunderstandings or unfair practices on the part of any Party, and to secure this end, it is hereby agreed that a Project Administrative Committee (PAC) shall be established to be comprised of the Contractor's representatives, the Unions party to the CWA, a representative of the Building Trades Council, and the Owner’s CWA Administrator, who shall meet at the Building Trades Council’s office according to a mutually agreeable monthly schedule. The PAC is tasked with addressing safety, compliance with Priority Hire requirements, apprenticeship utilization, preferred entry, job progress and other relevant issues that will affect the project. The contractor shall attend the PAC meetings as required, but not less than once each month, track Priority Hire Worker utilization and maintain copies of Craft Request Forms for the duration of the project. Representatives of Sub-contractors, at every tier level, may also be required to attend PAC meetings. The Owner’s CWA Administrator shall serve as the chair of the PAC. The Unions shall at such meetings present facts concerning any violations of any part of the CWA by the Contractors or its Sub-contractors. Additionally, the Unions agree to notify the Owner’s CWA Administrator upon discovery of a potential violation of this CWA. They shall also bring up any practice by the Contractor or the Contractor's Sub-contractors, which in their opinion might lead to a misunderstanding or dispute between the Parties. The Contractor or the Contractor's Sub- contractors shall bring in any complaints regarding failure of any employee or employees, or of the Unions to carry out any and all provisions of the CWA. 8.2 Any agreement or resolutions reached pursuant to the preceding paragraph shall not supersede, alter, modify, amend, add to or subtract from this Agreement unless specifically expressed elsewhere in this agreement. Prior to being effective, any amendments or revisions to this CWA shall be in writing and signed by all the Parties hereto. 8.3 All Parties signatory to this CWA acknowledge the importance of attendance and active support of the Project Administrative Committee and agree to participate in the meetings as their responsibility on the Project requires. 8.4 The PAC shall meet as required, but not less than once each month, to review the operation of the CWA. 8.5 The PAC shall be convened within forty-eight (48) hours on an emergency basis at the request of any party to the CWA. 8.6 The Owner is a party in interest and shall be sent contemporaneous copies of all notifications required under this article, and at their option, shall initiate or participate as a full party in any proceeding initiated under this Article.

PROJECT ADMINISTRATIVE COMMITTEE. 8.1 Section 1. The parties to this CWA hereby SCWA including all Contractors, recognize the necessity advantages of cooperation and the elimination communications as well as efficient and satisfactory resolution of disputes, misunderstandings or unfair practices on the part of any Party, and to secure a project. Towards this end, it is hereby agreed that the parties agree to participate in a Project Administrative Committee (PAC) ). SPS shall be established to be comprised schedule the PAC and notify the participants of the Contractor's representatives, the Unions party to the CWA, a representative of the Building Trades Council, and the Owner’s CWA Administrator, who shall meet at the Building Trades Council’s office according to a mutually agreeable monthly meeting schedule. The PAC shall be held at least monthly at a location specified by the Seattle Building Trades, and SPS may call an emergency meeting if appropriate. The PAC attendees shall include the Prime Contractor(s), SPS and Union representatives. The SPS CTE Program representative is tasked with addressing safetyencouraged to attend, compliance with and other SPS departments representatives may attend as necessary. Pre-Apprenticeship program representatives and Apprentice program representatives are encouraged to attend. SPS shall gather the appropriate reports and documents and deliver to the parties at least one week prior to the PAC meeting. SPS shall prepare copies of the reports and materials to distribute to the PAC membership and any interested audience or stakeholders upon their request. The PAC agenda will include a review and discussion of at least the following: • safety practices and incidents (if any), • hiring rates of each category of SPS Priority Hire requirementsHires and SPS Diversity Hiring, • apprenticeship utilizationutilization rates, • preferred entry, job • project progress and schedule, • appropriate workplace conditions, and • any other relevant issues or topics that will affect the project. The contractor shall attend the PAC meetings as required, but not less than once each month, track Priority Hire Worker utilization and maintain copies of Craft Request Forms for the duration of the project. Representatives of Sub-contractors, at every tier level, may also be required are identified by any party to attend PAC meetings. The Owner’s CWA Administrator shall serve as the chair of the PAC. The parties agree to identify and address issues as they arise and resolve them in a timely manner. Only signatory parties to this Agreement shall have voting rights when the PAC decides by vote. The PAC shall allow interested contractors and community members to attend meetings. SPS shall chair the Committee. SPS and Unions shall at such meetings present facts concerning any violations of any part each have one vote regardless of the CWA by the Contractors or its Sub-contractorsnumber of representatives from each that are in attendance. AdditionallyWhen in disagreement, the Unions agree Union and SPS may, by mutual agreement, appoint an impartial third party to notify break the Owner’s CWA Administrator upon discovery of tie with a potential violation of this CWAthird vote. PROJECT ADMINISTRATIVE COMMITTEE. 8.1 13.1 The parties to this CWA hereby recognize the necessity of cooperation cooperation, the prevention and the elimination of disputes, misunderstandings or unfair practices on the part of any Partyparty that may arise after award of the Contract or subcontract, and to secure this end, it is hereby agreed that a or during construction of the Project.
13.2 A Project Administrative Committee (PAC) shall be established consisting of regular members, as follows:
a. One
(1) Contractor representative who shall be appointed by the Contractor and who shall have the authority to be comprised of speak for and make decisions on the Contractor's representativesbehalf
b. One
(1) Council representative who shall be appointed as follows: The President will preside as the Council’s PAC representative, unless a work assignment dispute that involves the Unions President’s signatory craft as a claimant or party is before the PAC, in which case the Council’s PAC representative shall be the next officer in line who is not a claimant or a party to the CWA, a work assignment dispute. The Council’s PAC representative shall have the authority to speak for and make decisions on behalf of the Building Trades Council, Council after consultation with the appropriate signatory labor organization(s) as necessary.
c. One
(1) CWA Administrator representing the Owner who shall be appointed by the Owner and who shall have the authority to make decisions on the Owner’s behalf. The Owner through the CWA Administrator, who or Designee, shall meet at initiate and participate in all proceedings of the Building Trades Council’s office according to PAC as a mutually agreeable monthly scheduleparty in interest. The CWA Administrator or Designee shall chair all meetings of the PAC.
13.3 The PAC is will be tasked with addressing Project wide issues and disputes such as Project policies and work rules, Project safety, compliance with Priority Hire local area resident, youth, military, disadvantaged, reentry and minority hire requirements, apprenticeship utilization, preferred entryjob progress, job progress interruptions, core employee hire, work assignment disputes and other relevant significant issues that will as may affect the projectProject. The contractor PAC also shall attend be generally empowered to resolve alleged violations of this CWA that could have the effect of seriously impeding progress on the Project. The PAC’s dispute resolution process does not supersede, nor is it a substitute for the grievance process. Complaints involving alleged violations of local CBAs shall be resolved in accordance with the grievance process set forth in Article 21.
13.4 A Party or Parties may submit a dispute to the PAC meetings as requiredfor resolution, but not less than once each month, track Priority Hire Worker utilization and maintain copies of Craft Request Forms for the duration by providing a written copy of the project. Representatives of Sub-contractors, at every tier level, may also be required Party’s complaint to attend PAC meetingsthe CWA Administrator and all affected Parties. The Owner’s CWA Administrator shall serve as the chair call a meeting to address any such complaint promptly upon receipt of it. One
(1) representative of the PACContractor, one (1) representative of each subcontractor(s) involved in the complaint, one (1) representative of the Council, and one (1) representative of each labor organization(s) involved in the complaint will be permitted to attend and participate in the complaint’s resolution. The Unions shall at such meetings Affected parties will be given an opportunity to present facts concerning any violations and witness testimony relevant to the complaint in accordance with general standards of any part due process. Proceedings of the CWA PAC shall be informal and strict application of the rules of evidence shall not be required. If resolution of the complaint by mutual agreement of the Parties is not possible, the PAC shall decide the matter by open ballot, majority vote.
13.5 No decision or resolution reached by the Contractors or its Sub-contractors. Additionally, the Unions agree to notify the Owner’s CWA Administrator upon discovery of a potential violation of this CWA. They PAC shall also bring up any practice by the Contractor or the Contractor's Sub-contractors, which in their opinion might lead to a misunderstanding or dispute between the Parties. The Contractor or the Contractor's Sub- contractors shall bring in any complaints regarding failure of any employee or employees, or of the Unions to carry out any and all provisions of the CWA.
8.2 Any agreement or resolutions reached pursuant to the preceding paragraph shall not supersede, alter, modify, amend, add to or subtract from this Agreement unless specifically expressed elsewhere in CWA, or any local CBA except as the latter is modified or superseded by this agreementCWA. Prior to being effective, any amendments or revisions to this CWA The PAC’s resolution of a complaint shall be in reduced to writing and shall be signed by all the Parties heretoParties. Decisions of the PAC shall be final and shall not be subject to appeal, except decisions resolving work assignment disputes which may be appealed to “the Plan” in accordance with Section 22.1. Decisions of the PAC about work assignments that are not appealed to the Plan shall be precedent setting, only on this Project.
8.3 All Parties signatory to this CWA acknowledge the importance of attendance and active support of the Project Administrative Committee and agree to participate in the meetings as their responsibility on the Project requires.
8.4 13.6 The PAC shall meet as required, but not less than once each month, to review the overall operation of the CWA.
8.5 The CWA on the Project. In the case of emergencies, the PAC shall be convened by the CWA Administrator, within forty-eight (48) hours of a written request submitted by any Party. All Parties acknowledge the importance of attendance and active support of the PAC and shall participate in meetings of the PAC as one of their responsibilities on an emergency basis at the request of any party to the CWAProject.
8.6 13.7 To promote day to day Work Site continuity, cooperation and information exchange, the Contractor and Council shall have Labor Management meetings monthly. The Owner is a party in interest and shall be sent contemporaneous copies Contractor will also require the participation of all notifications required under this articlesubcontractors who are working, or soon to be working on the Project. At these monthly Labor Management meetings, the topics of discussion will include: job status, schedule updates, future work assignments, letter of assents, worker needs, and at their option, shall initiate any other issue or participate as concern that will help achieve a full party in any proceeding initiated under this Articleharmonious work site.
