Projected capacity. 21.4.3 Approximate date of commencement and length of the construction . Within ninety (90) days from the date of notice, the other Party has the right to decide whether or not it will participate in the proposed additional facilities, by means of a written notice. If such Party elects not to participate in the additional facilities, or fails to reply to the Participating Party's Proposal- which Party shall hereinafter be called the Constructing Party , the latter may proceed with the additional facilities and request Operator to construct, operate and maintain such Facilities at the sole cost and risk of the Constructing Party, without prejudice to the normal performance of the Joint Operations. The constructing Party may negotiate with the other Party for the use of said facilities for the Joint Operation. During the time the facilities are operated for the Constructing Party's sole account and risk, Operator shall charge to the latter all the costs of operation and maintenance of the additional facilities, in accordance with generally accepted accounting rules.
