Property Ownership / Easements. Developer further warrants that the Project will be constructed in a public right-of-way or upon real property for which Developer has obtained at least a twenty-foot wide, permanent easement dedicated to the District (or wider if required by the District), and a temporary easement for Developer entry for the purpose of constructing the Project and performing all of Developer’s warranty and other obligations contained herein. If any portion of the Sewer Main Extension is constructed within an easement, the Easement Agreement must be approved by the District prior to construction, assignable to the District, and in a form acceptable to the District.

  • Access to Property, Property’s Management, Property Lender, and Property Tenants Potential Investor agrees to not seek to gain access to any non-public areas of the Property or communicate with Property’s management employees, the holder of any financing encumbering the Property, the Property’s tenants, and the Owner’s partners in the ownership of the Property, without the prior consent of Owner or HFF, which consent may be withheld in the Owner’s sole discretion.
