Property Waiver of Subrogation. Consultant hereby waives all rights of recovery against (1) the Owner Parties, and (2) the Agency Parties with respect to any loss or damage, including consequential loss or damage, to Consultant’s personal property caused or occasioned by any peril or perils covered under any policy or policies of property insurance carried by Consultant. Consultant shall cause its insurance carriers to consent to such waiver of subrogation.
Property Waiver of Subrogation. Course of construction policies shall contain the following provisions:
A. The County shall be named as loss payee.
B. The insurer shall waive all rights of subrogation against the County.

Landlord and Tenant hereby waive and release any and all right of recovery against the other, including employees and agent (whether in contract or tort), arising during the Term for any and all loss of or damage to any property located within or constituting part of the Building or the Premises (whether or not the party suffering the loss or damage actually carries any insurance, recovers under any insurance or self-insures the loss or damage) resulting from loss of or damage to any such property by reason of an insured casualty loss. Landlord and Tenant shall each have their insurance policies issued in such form as to waive any right of subrogation as might otherwise exist. This mutual waiver is in addition to any other waiver or release contained in this Lease.

Sublessee hereby waives and releases any and all right of recovery against the Landlord or Lessor, including employees and agent (whether in contract or tort), arising during the Term for any and all loss of or damage to any property located within or constituting part of the Building or the Premises (whether or not the party suffering the loss or damage actually carries any insurance, recovers under any insurance or self-insures the loss or damage) resulting from loss of or damage to any such property by reason of an insured casualty loss. Pursuant to the Lease between the Landlord and the Lessor, Landlord and Lessor also hereby waive and release any and all right of recovery against Sublessee, as described above. Sublessee shall have its insurance policy issued in such form as to waive any right of subrogation as might otherwise exist. This mutual waiver is in addition to any other waiver or release contained in this Lease.
