Common use of Provider Convenience Clause in Contracts

Provider Convenience. The Provider may terminate this Rate Agreement, without cause, for its convenience, by giving no less than ninety (90) days written notice to the Department, unless both parties mutually agree in writing to a different notice period. The Provider shall be operating in a state of compliance with the terms and conditions of the Rate Agreement at the time the notice is issued and shall remain compliant for the duration of the performance period. The Provider shall notice the Department’s Contract Manager via the United States Post Office or delivery service that provides verification of delivery or hand delivery.
