Common use of Provisioning of Network Elements Clause in Contracts

Provisioning of Network Elements. IX.5.1 Ameritech shall provide Requesting Carrier unbundled Network Elements as set forth on Schedule 9.5. If Requesting Carrier submits “manual orders” for unbundled Network Elements in lieu of using any available electronic interfaces to submit such orders, the Parties agree that the terms and conditions set forth in Ameritech’s unbundled Network Elements tariff(s) shall apply to Requesting Carrier’s submission of such “manual orders” or, if no such terms or conditions are then set forth in the unbundled Network Elements tariff(s) or if such tariff(s) is not then in effect, the Parties shall apply the terms and conditions set forth in the Implementation Plan that address such manual orders. IX.5.2 Ameritech shall provide Requesting Carrier access to the functionalities for Ameritech's pre-ordering, ordering, provisioning, maintenance and repair and billing functions of the Operations Support Systems functions that relate to the Network Elements that Requesting Carrier purchases hereunder. Access to such functionalities for the Operations Support Systems functions shall be as provided in Schedule 9.2.6 and the Implementation Plan. IX.5.3 Prior to submitting an order for access to a Network Element which replaces, in whole or in part, a service offered by Ameritech or any other telecommunications provider for which Ameritech changes a primary Local Exchange Carrier (“PLEC”), Requesting Carrier shall comply with the requirements of Section 10.11.1. IX.5.4 Except as specifically provided in this Agreement or pursuant to an order of a court or commission of competent jurisdiction, Ameritech may not initiate any disconnect, suspension or termination of any Requesting Carrier ordered Network Element unless directed to do so by transmission of a Service Order or Ameritech's receipt of proper authorization to change such Customer's PLEC to a carrier other than Requesting Carrier.

IX.5.4 Except as specifically provided in this Agreement or pursuant If any dispute should occur concerning the selection of a PLEC by a Customer of a Party that is served by an unbundled Network Element, the Parties shall follow the procedures described on Schedule 10.11.2. IX.5.5 When Ameritech receives an order for access to an order unbundled Network Element or Elements (including conversion of a court or commission of competent jurisdiction, Ameritech may not initiate any disconnect, suspension or termination of any certain special access circuits) from Requesting Carrier ordered Network Element unless directed to do so by transmission for the provision of a Service Order or Ameritech's receipt of proper authorization to change such Customer's PLEC to a carrier other than local exchange Telecommunications Services for Requesting Carrier’s Customer, and that Customer is currently provided local exchange Telecommunications Services by another carrier (“Carrier of Record”) Ameritech shall notify such Carrier of Record of such order in the same manner as described in Section 10.11. 1. It shall then be the responsibility of the Carrier of Record and Requesting Carrier to resolve any issues related to that Customer. Requesting Xxxxxxx agrees to indemnify and hold Ameritech harmless against any and all losses that may result from Ameritech acting under this Section 9.5.5.

If Requesting Carrier Frontier submits “manual orders” for unbundled Network Elements in lieu of using any available electronic interfaces to submit such orders, the Parties agree that the terms and conditions set forth in Ameritech’s unbundled Network Elements tariff(s) shall apply to Requesting CarrierFrontier’s submission of such “manual orders” or, if no such terms or conditions are then set forth in the unbundled Network Elements tariff(s) or if such tariff(s) is not then in effect, the Parties shall apply the terms and conditions set forth in the Implementation Plan that address such manual orders. If Requesting Carrier submits “manual orders” for unbundled Network Elements in lieu of using any available electronic interfaces to submit such ordersthis Article, the Parties agree that Schedules attached hereto and as described in other relevant Articles relating to the terms provisioning of UNEs and conditions set forth in Ameritech’s unbundled Network Elements tariff(s) shall apply to Requesting Carrier’s submission of such “manual orders” or, if no such terms or conditions are then set forth in the unbundled Network Elements tariff(s) or if such tariff(s) is not then in effect, the Parties shall apply the terms and conditions set forth in the Implementation Plan that address such manual ordersUNE Combinations. IX.5.2 Ameritech 9.5.2 SBC-AMERITECH shall provide Requesting Carrier AT&T access to the functionalities for AmeritechSBC-AMERITECH's pre-ordering, ordering, provisioning, maintenance and repair and billing functions of the Operations Support Systems functions that relate to the Network Elements and UNE Combinations that Requesting Carrier AT&T purchases hereunderin accordance with Article XXXIII (OSS). Access to such functionalities for the Operations Support Systems functions shall be as provided in Schedule 9.2.6 and the Implementation PlanArticle XXXIII (OSS). IX.5.3 9.5.3 Prior to submitting an order for access to a Network Element to be provided on an unbundled basis which replaces, in whole or in part, a service offered by Ameritech SBC- AMERITECH or any other telecommunications provider for which Ameritech SBC-AMERITECH changes a primary Local Exchange Carrier (“PLEC”)local exchange carrier, Requesting Carrier AT&T shall comply with the requirements of Section 10.11.110.11.1 of Article X. 9.5.4 Intentionally Left Blank. IX.5.4 Except as specifically 9.5.5 Where UNEs provided to AT&T are dedicated to a single End User, if such UNEs are for any reason disconnected they shall be made available to SBC- AMERITECH for future provisioning needs, unless such UNE is disconnected in this Agreement or error. AT&T agrees to relinquish control of any such UNE concurrent with the disconnection of an AT&T End User’s service. 9.5.6 AT&T shall make available at mutually agreeable times the UNEs provided pursuant to an this Article in order to permit SBC-AMERITECH to test and make adjustments appropriate for maintaining the UNEs in satisfactory operating condition. No credit will be allowed for any interruptions involved during such testing and adjustments. 9.5.7 AT&T’s use of a court any SBC-AMERITECH UNE, or commission of competent jurisdictionits own equipment or facilities in conjunction with any SBC-AMERITECH network element, Ameritech will not materially interfere with or impair service over any facilities of SBC-AMERITECH, its affiliated companies or its connecting and concurring carriers involved in its services, cause damage to their plant, impair the privacy of any communications carried over their facilities or create hazards to the employees of any of them or the public. Upon reasonable written notice and opportunity to cure, SBC-AMERITECH may discontinue or refuse service if AT&T violates this provision, provided that such termination of service will be limited to AT&T’s use of the UNE(s) causing the violation. 9.5.8 Intentionally Left Blank 9.5.9 Intentionally Left Blank 9.5.10 Unbundled Network Elements may not initiate any disconnect, suspension be used in an arrangement whereby they are solely connected to or termination combined with SBC-AMERITECH access services or other SBC-AMERITECH tariffed service offerings with the exception of any Requesting Carrier ordered Network Element unless directed to do so by transmission of a Service Order or Ameritech's receipt of proper authorization to change such Customer's PLEC to a carrier other than Requesting Carriertariffed Collocation services where available.
