Public Entity Crimes. Neither Contractor, its parent corporations, subsidiaries, members, shareholders, partners, officers, directors or executives, nor any of its affiliates, contractors, suppliers, subcontractors, or consultants under this Agreement have been placed on the convicted vendor list following a conviction of a public entity crime. Contractor understands that a “public entity crime” as defined in section 287.133(1)(g), Florida Statutes, is “a violation of any state or federal law by a person with respect to and directly related to the transaction of business with any public entity or with an agency or political subdivision of any other state or with the United States…” Contractor further understands that any person or affiliate who has been placed on the convicted vendor list following a conviction for a public entity crime: (1) may not submit a bid, proposal, or reply on a contract: (a) to provide any goods or services to a public entity; (b) for the construction or repair of a public building or public work; or (c) for leases of real property to a public entity; (2) may not be awarded or perform work as a contractor, supplier, subcontractor, or consultant under a contract with any public entity; and (3) may not transact business with any public entity in excess of the threshold amount provided in section 287.017, Florida Statutes, for CATEGORY TWO for a period of 36 months from the date of being placed on the convicted vendor list.

Contractor understands that a “public entity crime” as defined in section 287.133(1)(gPursuant to Section 287.133(2)(a), Florida Statutes, is “a violation of any state or federal law by a person with respect to and directly related to the transaction of business with any public entity or with an agency or political subdivision of any other state or with the United States…” Contractor further understands that any person or affiliate who has been placed on the convicted vendor list following a conviction for a public entity crime: (1) crime may not submit a bid, proposal, or reply on a contract: (a) an agreement to provide any goods or services to a public entity; (b) may not submit a bid, proposal, or reply on an agreement with a public entity for the construction or repair of a public building or public work; may not submit bids, proposals, or (c) for replies on leases of real property to a public entity; (2) may not be awarded or perform work as a contractor, supplier, subcontractor, subcontractor or consultant under a contract an agreement with any public entity; entity and (3) may not transact business with any public entity in excess of the threshold amount provided in section Section 287.017, Florida Statutes, for CATEGORY TWO Category Two for a period of 36 thirty- six (36) months from the date of being placed on the convicted vendor list. GRANTEE affirmatively represents that it is aware of the prohibitions stated in Section 287.133(2)(a), Florida Statutes, and affirmatively represents that neither GRANTEE nor any affiliate of GRANTEE nor any person for whom GRANTEE is an affiliate as those terms are defined in Section 287.133(1), Florida Statutes, has been placed on the convicted vendor list or been convicted of a public entity crime.
