Common use of Public Utilities and Permitting Authorities Clause in Contracts

Public Utilities and Permitting Authorities. Where privately, publicly or cooperatively owned utility companies require rearrangements in connection with the proposed scope of services, and when certain permits will be required for construction, the Consultant shall make the necessary contacts and confer with the responsible authorities regarding the respective requirements as they may affect the Scope of Service and apprise the Owner of the results of all such contacts. The Consultant shall make no commitment with the utilities or permitting authorities binding upon the Owner. The Owner shall conduct all negotiations with the assistance of the Consultant and bear sole authority to finalize all commitments.
