Purpose of DPA. The parties warrant that the Provider must have access to Student Data to perform the study. Purpose of DPA. The purpose of this DPA is to describe the duties and responsibilities to protect Student Data including compliance with all applicable federal, state, and local privacy laws, rules, and regulations, all as may be amended from time to time. In performing these servicesservicesFor the purposes of FERPA, the Provider shall be considered a School Official as determined by the LEA with a legitimate educational interest, and performing services otherwise provided by the LEA. XXX is solely responsible for making this determination based on the Services. Provider shall be under the direct control and supervision of the LEA, with respect to its use of Student Data.

The purpose of this DPA is to describe the duties and responsibilities to protect Student Data (as defined in Exhibit “C”) transmitted to Provider from the LEA and its users pursuant to the Service Agreement including compliance with all applicable federalfederal and state privacy statutes, stateincluding the FERPA, PPRA, COPPA, IDEA, ISSRA, SOPPA, and local privacy lawsPIPA. This DPA supplements the Service Agreement and together with the Service Agreement, rules, and regulations, all is collectively referred to as may be amended from time to time. In performing these services, the Provider shall be considered a School Official with a legitimate educational interest, and performing services otherwise provided by the LEA. Provider shall be under the direct control and supervision of the LEA, with respect to its use of Student Data“Agreement.”

In performing these services, the Provider Contractor shall be considered a School Official with a legitimate educational interest, and performing services otherwise provided by the LEA. Provider With respect to the use and ,maintenance of Student Data, Contractor shall be under the direct control and supervision of the LEA, with respect to its use of Student Data.
