PURPOSE, SCOPE AND DEFINITIONS. Consistent with the principles that: (1) The public is entitled to the fullest practicable information regard- ing the decision-making processes of the Federal Government, and (2) the rights of individuals and the ability of the Export-Import Bank of the United States to carry out its statutory re- sponsibilities should be protected, this part is promulgated pursuant to the di- rective of section (g) of the Govern- ment in the Sunshine Act, 5 U.S.C. 552b(g), and specifically implements sections (b) through (f) of said Act, 5 U.S.C. 552b (b) through (f).
PURPOSE, SCOPE AND DEFINITIONS. The purpose of this Agreement is to permit each Participating Entity to exchange Confidential Information (as defined below) as needed to pursue the development and implementation of Cyber Mutual Assistance, including any request for or provision of cyber mutual assistance between Participating Entities in response to a cyber emergency or in connection with any Cyber Mutual Assistance initiative. “Confidential Information” under this Agreement consists of:
A) all information disclosed by any Participating Entity, or any of its employees, directors, officers, affiliates, partners, agents, advisors or other representatives (“Representatives”) pursuant to that Participating Entity’s participation in or contribution to the development or implementation of Cyber Mutual Assistance, including any Participating Entity’s request for or provision of cyber mutual assistance, whether disclosed prior to or following the execution of this Agreement;
B) any information or documentation produced by a Participating Entity, or any of its Representatives, under any Cyber Mutual Assistance initiative or related to a specific request for or response to cyber mutual assistance, including any analysis of such information, and whether produced prior to or following the execution of this Agreement;
C) any aggregation, consolidation, or listing of information or documentation disclosed by one or more Participating Entities, or any of their respective Representatives, pursuant to the development or implementation of a Cyber Mutual Assistance initiative including any Participating Entity’s request for or provision of cyber mutual assistance; and
D) all observations of equipment (including computer screens) and oral disclosures related to the development of any Cyber Mutual Assistance initiative or a specific request for or response to cyber mutual assistance, including the systems, operations, and activities of each Participating Entity, whether such observations or oral disclosures were made prior to or following the execution of this Agreement.

It is the purpose and intent of the parties to this Collective Agreement, hereinafter referred to as this “Collective Agreement”, to set forth the terms and conditions of employment with the Board including salary, allowances and other related provisions which govern the teachers covered by the Collective Agreement and to provide for a fair and expeditious procedure for the resolution of differences which may arise between the Parties.

1.02 Each of the parties to this Collective Agreement will make every reasonable effort to avert a breach of this Collective Agreement by any person governed by this Collective Agreement and in all respects will counsel members and representatives to abide by all terms or decisions made pursuant to or contained within this Collective Agreement and will not support in any way actions that would not be in accord with the provisions of this Collective Agreement. Notwithstanding the above, either party shall be free to challenge any arbitration decision.
