Qualification as an ACDBE. To qualify as a ACDBE under 49 CFR Part 23 and 26 as amended, a business concern must meet the applicable size standard and must be a small business (as defined by the Small Business Administration), which is: a) at least fifty-one percent (51%) owned and controlled by one or more socially and economically disadvantaged individuals, or in the case of any publicly owned business, at least fifty-one percent (51%) of the stock is owned by one or more socially and economically disadvantaged individuals; and (b) whose management and daily business operations are controlled by one or more of the socially and economically disadvantaged individuals who own it.
