Qualified Common Benefit Work Eligible for Reimbursement. In order to be eligible for reimbursement for time and efforts expended for common benefit work, said time and efforts must be (a) for the common benefit, (b) appropriately authorized as defined in footnote 2 above, (c) timely submitted and (d) approved by this Court. For the purposes of this Participation Agreement “common benefit work product” does not include trial or hearing transcripts, deposition transcripts of defendants’ or third-party witnesses or exhibits attached thereto, nor does it include the actual documents/images of documents produced by defendants in response to discovery requests or the discovery requests themselves.
