Common use of Qualified Insurer Clause in Contracts

Qualified Insurer. An insurance company duly qualified as such under the laws of the states in which the related Mortgaged Properties are located, duly authorized and licensed in such states to transact the applicable insurance business and to write the insurance provided and whose claims paying ability is rated by each Rating Agency in its highest rating category or whose selection as an insurer will not adversely affect the rating of the Certificates.

Qualified Insurer. An insurance company duly qualified as such under the laws of the states in which the related Mortgaged Properties are located, duly authorized and licensed in such states to transact the applicable insurance business and to write the insurance provided and whose claims paying ability is rated by each Rating Agency in its highest rating category or whose selection as an insurer will not adversely affect the rating ratings of the Certificates.

Qualified Insurer. An insurance company duly qualified as such under the laws of the states in which the related Mortgaged Properties are located, duly authorized and licensed in such states to transact the applicable insurance business and to write the insurance provided and whose claims paying ability provided, which insurer is rated approved in such capacity by each Rating Agency in its highest rating category or whose selection as an insurer will not adversely affect the rating of the CertificatesAgency.

Qualified Insurer. An insurance company duly qualified as such under the laws of the states in which the related Mortgaged Properties are located, duly authorized and licensed in such states to transact the applicable insurance business and to write the insurance provided and whose claims paying ability is rated by each Rating Agency in its highest rating category or whose selection the insurance policy issued by it, approved as an insurer will not adversely affect the rating of the Certificatesby Fxxxxx Mae and Fxxxxxx Mac.

Qualified Insurer. An insurance company duly qualified as such under the laws of the states in which the related Mortgaged Properties are located, duly authorized and licensed in such states to transact the applicable insurance business and to write the insurance provided and whose claims paying ability is rated by each Rating Agency in its highest rating category or whose selection as an insurer will not adversely affect the rating of the Certificatesprovided.

Qualified Insurer. An insurance company duly qualified as such under the laws of the states in which the related Mortgaged Properties are located, duly authorized and licensed in such states to transact the applicable insurance business related to this transaction and to write the insurance provided in connection therewith and whose claims paying ability is rated by each Rating Agency in its highest rating category or whose selection as an insurer will not adversely affect the rating of the Certificates.

Qualified Insurer. An insurance company duly qualified as such under the laws of the states in which the related Mortgaged Properties are located, duly authorized and licensed in such states to transact the applicable insurance business and to write the insurance provided and whose claims paying ability provided, which insurer is rated approved in such capacity by each Rating Agency in its highest rating category an Agency. Reconstitution: Any Securitization Transaction or whose selection as an insurer will not adversely affect the rating of the CertificatesWhole Loan Transfer.

Qualified Insurer. An insurance company duly qualified as such under the laws of the states in which the related Mortgaged Properties are located, duly authorized and licensed in such states to transact the applicable insurance business and to write the insurance provided and whose claims paying ability is rated by each Rating Agency in its highest rating category or whose selection provided, approved as an insurer will not adversely affect the rating of the Certificatesby Xxxxxx Mae and FHLMC.

Qualified Insurer. An insurance company duly qualified as such under the laws of the states in which the related Mortgaged Properties are located, duly authorized and licensed in such states to transact the applicable insurance business and to write the insurance provided provided, approved as an insurer by Xxxxxx Mae and whose claims paying ability is rated Xxxxxxx Mac (or such other rating as may be required by each a Rating Agency in its highest rating category or whose selection as an insurer will not adversely affect connection with a Securitization Transaction in order to achieve the rating of desired ratings for the Certificatessecurities to be issued in connection with such Securitization Transaction).

Qualified Insurer. An insurance company duly qualified as such under the laws of the states in which the related Mortgaged Properties are Property is located, duly authorized and licensed in such states to transact the applicable insurance business and to write the insurance provided provided, and approved as an insurer by Xxxxxx Xxx or Xxxxxxx Mac and whose claims paying ability is rated by each Rating Agency in its the two highest rating category or whose selection as an insurer will not adversely affect categories by the nationally recognized rating of agencies with respect to primary mortgage insurance and in the Certificatestwo highest rating categories by AM Best’s with respect to hazard and flood insurance.

Qualified Insurer. An insurance company duly qualified as such under the laws of the states in which the related Mortgaged Properties are located, duly authorized and licensed in such states to transact the applicable insurance business and to write the insurance provided and whose claims paying ability is rated by each Rating Agency in its highest rating category or whose selection provided, approved as an insurer will not adversely affect the rating of the Certificatesby Xxxxxx Xxx and FHLMC.

Qualified Insurer. An insurance company duly qualified as such under the laws of the states in which the related Mortgaged Properties are located, duly authorized and licensed in such states to transact the applicable insurance business and to write the insurance provided and whose claims paying ability is rated by each Rating Agency in its highest rating category or whose selection as an insurer will not adversely affect the rating of the CertificatesNotes, without taking into account the Policy.

Qualified Insurer. An insurance company duly qualified as such under the laws of the states in which the related Mortgaged Properties are located, duly authorized and licensed in such states to transact the applicable insurance business and to write the insurance provided provided, approved as an insurer by the Agencies and whose claims paying ability is rated by each Rating Agency in its the two highest rating category categories by the Standard & Poor's Ratings Group or whose selection as an insurer will not adversely affect Xxxxx'x Investors Service with respect to primary mortgage insurance and in the two highest rating of the Certificatescategories by Best's with respect to hazard and flood insurance.

Qualified Insurer. An insurance company duly qualified as such under the laws of the states in which the related Mortgaged Properties are Property is located, duly authorized and licensed in such states to transact the applicable insurance business and to write the insurance provided and whose claims paying ability is rated by each Rating Agency in its highest rating category or whose selection provided, approved as an insurer will not adversely affect the rating of the Certificatesby Fxxxxx Mxx or FHLMC.

Qualified Insurer. Qualified Insurer. An insurance company duly qualified as such under the laws of the states in which the related Mortgaged Properties are located, duly authorized and licensed in such states to transact the applicable insurance business and to write the insurance provided provided, which insurer is approved in such capacity by an Agency and whose claims paying ability is rated in the two highest rating categories by each any Rating Agency with respect to primary mortgage insurance and in its the two highest rating category or whose selection as an insurer will not adversely affect the rating of the Certificatescategories by Best’s with respect to hazard and flood insurance.

Qualified Insurer. An insurance company duly qualified as such under the laws of the states in which the related Mortgaged Properties are located, duly authorized and licensed in such states to transact the applicable insurance business and to write the insurance provided provided, and whose claims paying ability is rated meets the minimum level set forth by each Rating Agency in its highest rating category or whose selection as an insurer will not adversely affect the rating Xxxxxx Xxx guidelines with respect to the type of the Certificatesinsurance provided by such carrier.

Qualified Insurer. An insurance company duly qualified as such under the laws of the states in which the related Mortgaged Properties are Property is located, duly authorized and licensed in such states to transact the applicable insurance business and to write the insurance provided provided, and approved as an insurer by Fxxxxx Mxx or Fxxxxxx Mac and whose claims paying ability is rated by each Rating Agency in its the two highest rating category or whose selection as an insurer will not adversely affect categories by the nationally recognized rating of agencies with respect to primary mortgage insurance and in the Certificatestwo highest rating categories by AM Best’s with respect to hazard and flood insurance.

Qualified Insurer. An insurance company duly qualified as such under the laws of the states in which the related Mortgaged Properties are located, duly authorized and licensed in such states to transact the applicable insurance business and to write the insurance provided and whose claims paying ability is rated by each Rating Agency in its highest rating category or whose selection provided, approved as an insurer will not adversely affect the rating of the Certificatesby Xxxxxx Xxx and Xxxxxxx Mac.

Qualified Insurer. An insurance company duly qualified as such under the laws of the states in which the related Mortgaged Properties are located, duly authorized and licensed in such states to transact the applicable insurance business and to write the insurance provided and whose claims paying ability is rated by each Rating Agency in its highest rating category or whose selection as an insurer will not adversely affect the rating of the CertificatesCertificates (which in the case of the Class A5 Certificates and Class A6 Certificates is determined without regard to the Certificate Insurance Policy).

Qualified Insurer. An insurance company duly qualified as such under the laws of the states in which the related Mortgaged Properties are located, duly authorized and licensed in such states to transact the applicable insurance business and to write the insurance provided and whose claims paying ability is rated by each Rating Agency in its highest rating category or whose selection the insurance policy issued by it, approved as an insurer will not adversely affect the rating of the Certificatesby Xxxxxx Mae or Xxxxxxx Mac.

Qualified Insurer. An insurance company duly qualified as such under the laws of the states in which the related Mortgaged Mortgage Properties are located, duly authorized and licensed in such states to transact the applicable insurance business and to write the insurance provided and whose claims paying ability is rated by each Rating Agency in its highest rating category or whose selection the insurance policy issued by it, approved as an insurer will not adversely affect by the rating of the CertificatesAgency.

Qualified Insurer. An insurance company duly qualified as such under the laws of the states in which the related Mortgaged Properties are located, duly authorized and licensed in such states to transact the applicable insurance business and to write the insurance provided and whose claims paying ability is rated by each Rating Agency in its highest rating category or whose selection as an insurer will not adversely affect the rating of ratings on the CertificatesNotes, without taking into account the related Policy.

Qualified Insurer. An insurance company duly qualified as such under the laws of the states in which the related Mortgaged Properties are located, duly authorized and licensed in such states to transact the applicable insurance business and to write the insurance provided and whose claims paying ability is rated by each Rating Agency in its highest with a rating category or whose selection as an insurer will not adversely affect set forth in the rating of the Certificatesapplicable Underwriting Guidelines.

Qualified Insurer. An insurance company duly qualified as such under the laws of the states in which the related Mortgaged Properties are located, duly authorized and licensed in such states to transact the applicable insurance business and to write the insurance provided and whose claims paying ability is rated by each Rating Agency in its highest rating category or whose selection as an insurer will not adversely affect the rating of the Certificates (which in the case of the Class 3-A2 Certificates, is determined without regard to the Certificate Insurance Policy).

Qualified Insurer. An insurance company duly qualified as such under the laws of the states in which the related Mortgaged Properties are located, duly authorized and licensed in such states to transact the applicable insurance business and to write the insurance provided and whose claims paying ability is rated by each Rating Agency in its highest rating category or whose selection as an insurer will not adversely affect the rating of the Certificates (which in the case of the Class 3-A3 Certificates, is determined without regard to the Certificate Insurance Policy).

Qualified Insurer. An insurance company duly qualified as such under the laws of the states in which the related Mortgaged Properties are located, duly authorized and licensed in such states to transact the applicable insurance business and to write the insurance provided provided, and whose claims paying ability is rated by each Rating Agency in its highest rating category or whose selection approved as an insurer will not adversely affect by prudent mortgage lenders in the rating of the Certificatessecondary market.

Qualified Insurer. An insurance company duly qualified as such under the laws of the states in which the related Mortgaged Properties are located, duly authorized and licensed in such states to transact the applicable insurance business and to write the insurance provided provided, and whose claims paying ability is rated in the two highest rating categories by each applicable Rating Agency with respect to primary mortgage insurance and in its the two highest rating category or whose selection as an insurer will not adversely affect the rating of the Certificatescategories in Best's Key Rating Guide with respect to hazard and flood insurance.

Qualified Insurer. An insurance company duly qualified as such under the laws of the states in which the related Mortgaged Properties are located, duly authorized and licensed in such states to transact the applicable insurance business and to write the insurance provided provided, approved as an insurer by Xxxxxx Mae, and whose claims paying ability is rated in the two highest rating categories by each applicable Rating Agency with respect to primary mortgage insurance and in its the two highest rating category or whose selection as an insurer will not adversely affect the rating of the Certificatescategories in Best’s Key Rating Guide with respect to hazard and flood insurance.

Qualified Insurer. Qualified Insurer. An insurance company duly qualified as such under the laws of the states in which the related Mortgaged Properties are located, duly authorized and licensed in such states to transact the applicable insurance business and to write the insurance provided and whose claims paying ability is rated by each Rating Agency in its highest rating category or whose selection as an insurer will not adversely affect the rating of the CertificatesCertificates (which in the case of the Class 1-A3A, Class 1-A5B and Class 1-A6 Certificates shall be determined without regard to the Certificate Insurance Policy).

Qualified Insurer. An insurance company duly qualified as such under the laws of the states in which the related Mortgaged Properties are located, duly authorized and licensed in such states to transact the applicable insurance business and to write the insurance provided and whose claims paying ability is rated by each Rating Agency in its highest rating category or whose selection provided, approved as an insurer will not adversely affect the rating of the Certificatesby Fxxxxx Mxx or FHLMC.

Qualified Insurer. An Any insurance company duly qualified as such under the laws of the state or states in which the related Mortgaged Property or Mortgaged Properties is or are located, duly authorized and licensed in such state or states to transact the applicable type of insurance business in which it is engaged and to write approved as an insurer by the insurance provided and whose Master Servicer, so long as the claims paying ability of which is acceptable to the Rating Agencies for mortgage-backed notes having the same rating as the Notes rated by each the Rating Agency in its highest rating category or whose selection Agencies as an insurer will not adversely affect the rating of the CertificatesClosing Date.

Qualified Insurer. An insurance company duly qualified as such under the laws of the states in which the related Mortgaged Properties are located, duly authorized and licensed in such states to transact the applicable insurance business and to write the insurance provided and whose claims paying ability is rated by each Rating Agency in its highest rating category or whose selection provided, approved as an insurer will not adversely affect the rating of the Certificatesby FNMA and FHLMC.

Qualified Insurer. An insurance company duly qualified as such under the laws of the states in which the related Mortgaged Properties are located, duly authorized and licensed in such states to transact the applicable insurance business and to write the insurance provided and whose claims paying ability is rated by each Rating Agency in its highest rating category or whose selection as an insurer will not adversely affect the rating of ratings on the CertificatesNotes, without taking into account the Policy.

Qualified Insurer. Qualified Insurer. An insurance company duly qualified as such under the laws of the states state in which the related Mortgaged Properties are Property is located, duly authorized and licensed in such states state to transact the applicable insurance business and to write the insurance provided and whose claims paying ability provided, which insurer is rated approved in such capacity by each Rating Agency in its highest rating category or whose selection as an insurer will not adversely affect the rating of the CertificatesAgency.

An insurance company duly qualified as such under the laws of the states in which the related Mortgaged Properties are located, duly authorized and licensed in such states to transact the applicable insurance business and to write the insurance provided and whose claims paying ability is rated by each Rating Agency in its highest rating category or whose selection provided, approved as an insurer will not adversely affect the rating of the Certificatesby Fanxxx Xxe xx FHLMC.

Qualified Insurer. An insurance company duly qualified as such under the laws of the states in which the related Mortgaged Properties are located, duly authorized and licensed in such states to transact the applicable insurance business and to write the insurance provided and whose claims paying ability is rated by each Rating Agency in its highest rating category or whose selection as an insurer will not adversely affect the rating of the CertificatesCertificates (which in the case of the Guaranteed Certificates shall be determined without regard to the Certificate Insurance Policy).

Qualified Insurer. An insurance company duly qualified as such under the laws of the states in which the related Mortgaged Properties are located, duly authorized and licensed in such states to transact the applicable insurance business and to write the insurance provided and whose claims paying ability is rated by each Rating Agency in its highest rating category or whose selection as an insurer will not adversely affect the rating of the CertificatesCertificates (which in the case of the Class 1-A2B, Class 1-A3B, Class 1-A5 and Class 1-A6 Certificates shall be determined without regard to the Certificate Insurance Policy).

An Any insurance company duly qualified as such under the laws of the state or states in which the related Mortgaged Property or Mortgaged Properties is or are located, duly authorized and licensed in such state or states to transact the applicable type of insurance business in which it is engaged and to write approved as an insurer by the insurance provided and whose Master Servicer, so long as the claims paying ability of which is acceptable to the Rating Agencies for pass-through certificates having the same rating as the related Certificates rated by each the Rating Agency in its highest rating category or whose selection Agencies as an insurer will not adversely affect the rating of the CertificatesClosing Date.

Qualified Insurer.
