Common use of Quiet Enjoyment Clause in Contracts

Quiet Enjoyment. Landlord covenants that Tenant, upon paying the Rent and performing its obligations contained in this Lease, may peacefully and quietly have, hold and enjoy the Premises, free from any claim by Landlord or persons claiming under Landlord, but subject to all of the terms and provisions hereof, provisions of Applicable Laws and rights of record to which this Lease is or may become subordinate. This covenant is in lieu of any other quiet enjoyment covenant, either express or implied.

Quiet Enjoyment. This covenant is in lieu modifications of any other quiet enjoyment covenant, either express or impliedsame.

Landlord covenants that TenantTenant upon performing the terms, upon paying conditions and covenants of this Lease shall have the Rent peaceful, quiet, possession, use and performing its obligations contained in this Lease, may peacefully and quietly have, hold and enjoy enjoyment of the Premises, free from any claim by Premises without interference on the part of Landlord or persons any party claiming by, through, or under LandlordLandlord and Landlord shall defend Tenant in such peaceful and quiet possession, but subject to all use and enjoyment of the terms and provisions hereof, provisions of Applicable Laws and rights of record to which this Lease is or may become subordinate. Quiet Enjoyment. The Landlord covenants that Tenantto provide the Tenant with quiet enjoyment and possession of the Premises during the Term, upon paying the Rent and performing its obligations contained in this Lease, may peacefully and quietly have, hold and enjoy the Premises, free from any claim by Landlord or persons claiming under Landlord, but subject to all of the terms and provisions hereof, provisions conditions of Applicable Laws this Lease. The Landlord covenants that Tenantif, upon paying and so long as, the Tenant pays the Basic Rent and performing its obligations contained in this LeaseAdditional Rent as herein provided, may peacefully and performs the covenants hereof, the Landlord shall do nothing to affect the Tenant’s right to peaceably and quietly have, hold and enjoy the PremisesPremises for the Term herein mentioned, free from any claim by Landlord or persons claiming under Landlord, but subject to all of the terms and provisions hereof, provisions of Applicable Laws this Lease, the Condominium Documents (hereinafter defined) and rights to any mortgage or deed of record trust to which this Lease is or may become shall be subordinate. This covenant is in lieu of any other quiet enjoyment covenant, either express or implied.

Quiet Enjoyment. Landlord covenants that Tenant, upon Tenant paying the Rent Rents due hereunder and duly performing its obligations contained in this Leaseand observing all of Tenant's other Lease obligations, may peacefully covenants and agreements, Tenant peaceably and quietly may have, hold and enjoy the PremisesLeased Premises for the Lease Term, free from subject and subordinate as provided in this Lease. Landlord shall have no liability whatsoever to Tenant for any claim breach of this covenant occasioned by Landlord the acts or persons claiming under Landlord, but subject to all of the terms and provisions hereof, provisions of Applicable Laws and rights of record to which this Lease is or may become subordinate. Subject to the terms and conditions of this Lease, Landlord covenants that Tenant, upon paying the Rent Tenant shall and performing its obligations contained in this Lease, may peacefully and quietly have, hold and enjoy the Premises, free Premises from any claim those parties claiming possession or rights to the Premises by Landlord or persons claiming under through Landlord, but subject to all of the other terms and provisions hereof, provisions of Applicable Laws and rights of record to which this Lease is or may become subordinate. Landlord covenants that Tenant, upon paying Landlord is lawfully seized of and in possession of the Rent Lease Premises and performing its obligations contained in this Lease, may peacefully agrees that if Tenant shall promptly pay the rent and quietly have, hold and enjoy the Premises, free from any claim by Landlord or persons claiming under Landlord, but subject to perform all of the terms covenants and provisions agreements herein stipulated to be performed on Tenant's part, Tenant shall have the peaceable and quiet enjoyment and possession of the Leased Premises during the term hereof, provisions without any manner of Applicable Laws and rights of record to which this Lease is hindrance from Landlord or may become subordinate. This covenant is in lieu of any other quiet enjoyment covenantperson lawfully claiming through Landlord, either express or impliedsubject to the conditions herein set forth.

Landlord covenants that so long as Tenant shall timely pay all rents and other charges due to Landlord from Tenant hereunder and keep, observe and perform all covenants, promises and agreements on Tenant’s part to be kept, upon paying the Rent observed and performing its obligations contained in this Leaseperformed hereunder, may peacefully Tenant shall peaceably and quietly have, hold and enjoy the Premises, free from any claim by Landlord or persons claiming under Landlord, but subject to all full possession and use of the terms Premises and provisions hereofthe easements, provisions of Applicable Laws rights-of-way, rights, privileges, benefits and rights of record to which this Lease is or may become subordinate. This covenant is in lieu of any other quiet enjoyment covenant, either express or impliedappurtenances belonging thereto throughout the Term without interference from Landlord.

This covenant is in lieu of any other quiet enjoyment covenant, either express or impliedLease.

Landlord covenants that it has the right to make this Lease for the Term aforesaid, and that if Tenant shall pay the rent and perform all of the covenants, terms, conditions and agreements of this Lease to be performed by Tenant, upon paying Tenant shall, during the Rent and performing its obligations contained in this LeaseTerm hereby created, may peacefully freely, peaceably and quietly have, hold occupy and enjoy the Premises, free from any claim full possession of the Premises without molestation or hindrance by Landlord or persons any party claiming through or under Landlord, but subject to all of the terms and provisions hereof, provisions of Applicable Laws and rights of record to which this Lease is or may become subordinate. This covenant is in lieu of any other quiet enjoyment covenant, either express or impliedParagraph 20(B) below.

Quiet Enjoyment. 2.01 Quiet Enjoyment Landlord covenants that Tenant, upon on paying the Rent Rents herein provided and keeping, performing its obligations contained in this Leaseand observing the covenants, may peacefully agreements and conditions herein required of Tenant, shall peaceably and quietly have, hold and enjoy the Premises, free from any claim by Landlord or persons claiming under Landlord, but Premises for the Lease Term subject to all of the terms and provisions hereof, provisions of Applicable Laws and rights of record to which this Lease is or may become subordinate. This covenant is in lieu and encumbrances, easements, rights, covenants, conditions and restrictions of any other quiet enjoyment covenant, either express or impliedrecord.

Quiet Enjoyment. Landlord covenants that Tenantthat, upon paying Tenant’s payment of the Rent required hereunder and performing its obligations contained in this Lease, may peacefully and quietly have, hold and enjoy the Premises, free from any claim by Landlord or persons claiming under Landlord, but subject to performance of all of the terms and provisions hereofconditions of the Lease, provisions Tenants peaceful and quiet enjoyment of Applicable Laws the Leased Premises shall not be disturbed by Landlord or anyone properly claiming by, through or under Landlord, or Landlord’s successors or assigns. Notwithstanding the foregoing, this provision is subject to all mortgages, encumbrances, easements and rights of record underlying leases to which this Lease is may be or may become subordinate. This covenant is in lieu of any other quiet enjoyment covenant, either express or implied.

Quiet Enjoyment. So long as this Lease has not been terminated, Landlord covenants that Tenant, upon paying the Rent Tenant shall and performing its obligations contained in this Lease, may peacefully peaceably and quietly have, hold hold, and enjoy the PremisesPremises for the Term, free subject to the terms of this Lease, without molestation, hindrance, or disturbance by or from any claim by Landlord or persons by anyone claiming under by or through Landlord or having title to the Premises paramount to Landlord, but subject to all of the terms and provisions hereof, provisions of Applicable Laws and rights of record to which this Lease is or may become subordinate. This covenant is in lieu free of any other quiet enjoyment covenantencumbrance created or suffered by Landlord, either express or impliedexcept Permitted Exceptions.

Quiet Enjoyment. Landlord covenants covenants, represents and warrants that Tenant, upon paying the Rent timely payment of the rent and performing its obligations contained in this Leasethe timely performance of all other covenants and agreements hereunder, may peacefully shall peaceably and quietly have, hold and enjoy the Premises, free from any claim Premises without interruption or hindrance by Landlord or persons any other person or entity holding or claiming by, through or under Landlord, but subject to all of the terms and provisions hereof, provisions of Applicable Laws and rights of record to which this Lease is or may become subordinate. This covenant is in lieu of any other quiet enjoyment covenant, either express or impliedexcept as otherwise provided herein.

Quiet Enjoyment. Landlord covenants that Tenant, upon paying the Rent keeping and performing its obligations each and every covenant, agreement, term, provision and condition herein contained in this Leaseon the part and on behalf of Tenant to be kept and performed, may peacefully and quietly have, hold and enjoy shall have quiet enjoyment of the Premises, free from any claim Premises without hindrance or molestation by Landlord or persons by any other person lawfully claiming by, through or under Landlord, but subject to all of the terms and provisions hereofcovenants, agreements, terms, provisions and conditions of Applicable Laws and rights of record to which this Lease is or may become subordinate. This covenant is in lieu of any other quiet enjoyment covenant, either express or impliedLease.

Quiet Enjoyment. Landlord covenants that Tenant, upon paying performing all of its covenants, agreements [ILLEGIBLE] conditions of this lease, shall have quiet and peaceful possession of the Rent and performing its obligations contained in this Lease, may peacefully and quietly have, hold and enjoy the Premises, free from any claim by Landlord or persons Premises as against anyone claiming under [ILLEGIBLE] through Landlord, but subject subject, however, to all the exceptions, reservations and conditions of the terms and provisions hereof, provisions of Applicable Laws and rights of record to which this Lease is or may become subordinate. This covenant is in lieu of any other quiet enjoyment covenant, either express or impliedlease.

Quiet Enjoyment. Landlord covenants that it has the right to make this Lease for the term aforesaid, and that if Tenant shall pay the rent and perform all of the covenants, terms, conditions and agreements of this Lease to be performed by Tenant, upon paying Tenant shall, during the Rent and performing its obligations contained in this Leaseterm hereby created, may peacefully freely, peaceably and quietly have, hold occupy and enjoy the Premises, free from any claim full possession of the Premises without molestation or hindrance by Landlord or persons any party claiming through or under Landlord, but subject to all of the terms and provisions hereof, provisions of Applicable Laws and rights of record to which this Lease is or may become subordinate. This covenant is in lieu of any other quiet enjoyment covenant, either express or impliedparagraph (b) hereof.

Quiet Enjoyment. Landlord covenants that Tenant, upon paying the Rent performing all of its covenants, agreements and performing its obligations contained in conditions of this Lease, shall have quiet and peaceful possession of the Premises as against anyone claiming by or through Landlord, subject, however, to the terms of this Lease, subject to existing deed restrictions and easements of record, as set forth in the title report for the Premises attached hereto as Exhibit “K” and such other matters as may peacefully and quietly have, hold and enjoy the Premises, free from any claim be placed of record by Landlord or persons claiming under Landlord, but subject to all of the terms and provisions hereof, provisions of Applicable Laws and rights of record to which in accordance with this Lease is or may become subordinate. This covenant is in lieu of any other quiet enjoyment covenant, either express or impliedLease.

Quiet Enjoyment. Landlord covenants that Tenant, upon paying the Base Rent, Additional Rent and all other sums payable under this Lease and performing its obligations contained in all covenants and conditions required of Tenant under this Lease, Lease shall and may peacefully and quietly have, hold and enjoy the Premises, free from any claim Premises without hindrance or molestation by Landlord or persons claiming under Landlord, but subject to all of the terms and provisions hereof, provisions of Applicable Laws and rights of record to which this Lease is or may become subordinate. This covenant is in lieu of any other quiet enjoyment covenant, either express or implied.23

Landlord covenants that Tenant, upon Tenant on paying the Rent rent and performing its and observing Tenant's obligations contained in this Lease, may shall peacefully and quietly have, hold and enjoy the Premisesdemised premises free of lawful claims made by, free from any claim by Landlord through or persons claiming under Landlord, but subject to all of the terms and provisions hereof, provisions and subject to mortgages, rights, easements, restrictions, covenants and other matters of Applicable Laws and rights of record to which this Lease is or may become subordinate. This covenant is in lieu of any other quiet enjoyment covenant, either express or impliedrecord.

Quiet Enjoyment. Landlord covenants that Tenant, upon paying it has the Rent and performing its obligations contained in right to enter into this Lease, may peacefully and quietly havethat if Tenant shall perform timely all of its obligations hereunder, hold then, subject to the provisions of this Lease, Tenant shall have the right during the Lease Term to occupy and enjoy the Premises, free from full possession of the Premises without hindrance or objection by any claim by Landlord or persons lawfully claiming under Landlord, but subject Landlord to all have title to the Premises superior to Tenant. The foregoing covenant of the terms and provisions hereof, provisions of Applicable Laws and rights of record to which this Lease is or may become subordinate. This covenant quiet enjoyment is in lieu of any other quiet enjoyment covenant, either express or implied.

Quiet Enjoyment. Landlord covenants that Tenant, upon on paying the Rent rent and performing its the tenant obligations contained in this LeaseLease within the applicable notice and cure periods, may shall peacefully and quietly have, hold and enjoy the Premises, free from any claim by Landlord or persons claiming under Landlord, but subject to all of the terms and provisions hereof, provisions of Applicable Laws law and rights of record to which this Lease is or may become subordinate. This covenant is in lieu of any other so-called quiet enjoyment covenant, either express or implied.

Quiet Enjoyment. Landlord covenants that Tenant, upon paying the Base Rent, Additional Rent and all other sums payable under this Lease and performing its obligations contained in all covenants and conditions required of Tenant under this Lease, Lease shall and may peacefully and quietly have, hold and enjoy the Premises, free from any claim Premises without hindrance or molestation by Landlord or persons anyone claiming by, through or under Landlord, but subject to all of the terms and provisions hereof, provisions of Applicable Laws and rights of record to which this Lease is or may become subordinate. This covenant is in lieu of any other quiet enjoyment covenant, either express or impliedLease.

Landlord covenants that Tenant, upon Tenant on paying the Rent rent and performing its and observing Tenant's obligations contained in this Lease, may shall peacefully and quietly have, hold and enjoy the Premisesdemised premises free of lawful claims made by, free from any claim by Landlord through or persons claiming under Landlord, but subject to all of the terms and provisions hereof, provisions and subject to mortgages, rights, easements, restrictions, covenants and other matters of Applicable Laws and rights of record to which this Lease is or may become subordinaterecord. This covenant is in lieu of any other quiet enjoyment covenant, either express or implied.SECTION THREE

Quiet Enjoyment. Landlord covenants that TenantTenant shall and may peaceably have, upon paying hold, and enjoy exclusive possession and use of the Rent and performing its obligations contained in Premises for the Term of this Lease, may peacefully and quietly have, hold and enjoy the Premises, free from any claim by Landlord or persons claiming under Landlord, but subject to all the other terms, provisions, agreements and conditions of this Lease, PROVIDED that Tenant pays the terms and provisions hereof, provisions of Applicable Laws and rights of record Total Rent to which be paid by Tenant under this Lease is or may become subordinate. This covenant is in lieu and complies with each and every other obligation of any other quiet enjoyment covenant, either express or impliedTenant under this Lease.

Quiet Enjoyment. Landlord covenants that Tenant, upon on paying the Rent and performing its Tenant's obligations contained in this Lease, may shall peacefully and quietly have, hold and enjoy the PremisesPremises throughout the Term without hindrance, free from ejection or molestation by any claim by Landlord or persons Person lawfully claiming under Landlord, but subject to all of the other terms and provisions hereofof this Lease, provisions of Applicable Laws the Protective Covenants and rights to all mortgages and underlying leases of record to which this Lease is or may become subject and subordinate. This covenant is in lieu of any other quiet enjoyment covenant, either express or implied.

Quiet Enjoyment. Landlord covenants covenants, represents and warrants that it has full right and power to execute and perform this Lease and to grant the estate demised herein and that Tenant, upon paying on payment of the Rent rent and performing its obligations contained in this Leaseperformance of the covenants and agreements hereof, may peacefully shall peaceably and quietly have, hold and enjoy the PremisesDemised Premises and all rights, free from easements, appurtenances and privileges belonging or in any claim by Landlord way pertaining thereto during the Lease term without molestation or persons claiming under Landlord, but subject to all of the terms and provisions hereof, provisions of Applicable Laws and rights of record to which this Lease is or may become subordinate. This covenant is in lieu hindrance of any other quiet enjoyment covenant, either express or impliedperson whomsoever.

Quiet Enjoyment. The Landlord covenants with the Tenant that Tenant, upon paying it has good right to lease said premises and that it will suffer and permit the Rent and performing its obligations contained in this Lease, may peacefully and quietly have, hold and enjoy the Premises, free from any claim by Landlord or persons claiming under Landlord, but subject to Tenant (it keeping all of the terms covenants on its part as herein contained) to occupy, possess and provisions quietly enjoy said premises during the term hereof, provisions without hindrance from Landlord or any person claiming by, from or under it, subject, nevertheless, to the terms of Applicable Laws this Lease and rights of record any mortgage, ground lease or agreements to which this Lease is or may become subordinate. This covenant is in lieu of any other quiet enjoyment covenant, either express or impliedsubordinated.

Quiet Enjoyment. Landlord covenants and agrees with Tenant that Tenantupon Tenant paying rent and other monetary sums due under the Lease, upon paying the Rent and performing its obligations contained in this Lease, covenants and conditions under the Lease Tenant shall and may peacefully peaceably and quietly have, hold and enjoy the PremisesPremises for the term, free from any claim by Landlord or persons claiming under Landlordsubject, but subject however, to all the terms of the terms lease and provisions hereof, provisions of Applicable Laws and rights of record to which this Lease is or may become subordinate. This covenant is in lieu of any other quiet enjoyment covenantof the aforesaid ground leases, either express mortgages or implieddeeds of trust described above.

Quiet Enjoyment. Landlord covenants that Tenant, upon paying the Base Rent, Additional Rent and all other sums payable under this Lease and performing its obligations contained in all covenants and conditions required of Tenant under this Lease, Lease shall and may peacefully and quietly have, hold and enjoy the Premises, free from any claim Premises without hindrance or molestation by Landlord or persons claiming under Landlord, but subject to all of the terms and provisions hereof, provisions of Applicable Laws and rights of record to which this Lease is or may become subordinate. This covenant is in lieu of any other quiet enjoyment covenant, either express or implied's Agents.
