Quiet Enjoyment. Landlord covenants that Tenant, upon paying the Rent and performing its obligations contained in this Lease, may peacefully and quietly have, hold and enjoy the Premises, free from any claim by Landlord or persons claiming under Landlord, but subject to all of the terms and provisions hereof, provisions of Applicable Laws and rights of record to which this Lease is or may become subordinate. This covenant is in lieu of any other quiet enjoyment covenant, either express or implied.

Landlord covenants that Tenantcovenants, upon paying the Rent and performing its obligations contained in this Lease, may peacefully and quietly have, hold and enjoy the Premises, free from any claim by Landlord or persons claiming under Landlord, but subject to all of the terms and provisions hereof, provisions of Applicable Laws and rights of record to which this Lease is or may become subordinate. This covenant is in lieu of any other implied covenant of quiet possession or quiet enjoyment, that so long as Tenant is in compliance with the covenants and conditions set forth in this Lease within applicable notice and cure periods, Tenant shall have the right to quiet enjoyment covenantof the Premises without hindrance or interference from Landlord or those claiming through Landlord, either express and subject to the covenants and conditions set forth in the Lease and to the rights of any Mortgagee or impliedground lessor.

Quiet Enjoyment. The Landlord covenants that Tenantif, upon paying and so long as, the Tenant pays the Basic Rent and performing its obligations contained in this LeaseAdditional Rent as herein provided, may peacefully and performs the covenants hereof, the Landlord shall do nothing to affect the Tenant’s right to peaceably and quietly have, hold and enjoy the PremisesPremises for the Term herein mentioned, free from any claim by Landlord or persons claiming under Landlord, but subject to all of the terms and provisions hereof, provisions of Applicable Laws this Lease, the Condominium Documents (hereinafter defined) and rights to any mortgage or deed of record trust to which this Lease is or may become shall be subordinate. This covenant is in lieu of any other quiet enjoyment covenant, either express or implied.

Quiet Enjoyment. Landlord covenants that Tenantand agrees that, upon paying the Rent so long as this Lease is in full force and performing its obligations contained in this Leaseeffect, may peacefully Tenant shall lawfully and quietly havehold, hold occupy and enjoy the Premises, free from any claim Premises during the Term (as may be extended) of this Lease without disturbance by Landlord or persons by any person having an interest in the Premises paramount to Landlord's interest or by any person claiming through or under Landlord, but subject . The foregoing express covenant shall be in addition to all and not in derogation of the terms and provisions hereof, provisions of Applicable Laws and any implied or other rights of record to which this Lease is or may become subordinate. This covenant is in lieu of any other quiet enjoyment covenant, either express or impliedTenant may have under applicable law.

Quiet Enjoyment. Landlord covenants that Tenant, Tenant upon paying the Rent keeping and performing its obligations each and every covenant, agreement, term, provision and condition herein contained in this Leaseon the part and on behalf of Tenant to be kept and performed, may peacefully and shall quietly have, hold and enjoy the Premises, free from any claim Demised Premises without hindrance or molestation by Landlord or persons by any other person lawfully claiming by, through or under Landlord, but the same subject to all the covenants, agreements, terms, provisions and conditions of this Lease and the effect of the terms and provisions hereof, provisions application of Applicable Laws and rights of record to which this Lease is or may become subordinate. Landlord covenants covenants, represents and warrants that it has full right and power to execute and perform this Lease and to grant the estate demised herein and that Tenant, upon paying on payment of the Rent rent and performing its obligations contained in this Leaseperformance of the covenants and agreements hereof, may peacefully shall peaceably and quietly have, hold and enjoy the PremisesDemised Premises and all rights, free from easements, appurtenances and privileges belonging or in any claim by Landlord way pertaining thereto during the Lease term without molestation or persons claiming under Landlord, but subject to all of the terms and provisions hereof, provisions of Applicable Laws and rights of record to which this Lease is or may become subordinate. Landlord covenants that Tenant, upon Tenant paying the Rent Rents due hereunder and duly performing its obligations contained in this Leaseand observing all of Tenant's other Lease obligations, may peacefully covenants and agreements, Tenant peaceably and quietly may have, hold and enjoy the PremisesLeased Premises for the Lease Term, free from subject and subordinate as provided in this Lease. Landlord shall have no liability whatsoever to Tenant for any claim breach of this covenant occasioned by Landlord the acts or persons claiming under Landlord, but subject to all of the terms and provisions hereof, provisions of Applicable Laws and rights of record to which this Lease is or may become subordinate. This covenant is in lieu omissions of any other quiet enjoyment covenantsubtenant, either express or impliedany transferee, successor or assignee of Landlord.

Quiet Enjoyment. The Landlord covenants with the Tenant for quiet enjoyment; provided, however, that Tenantnothing contained in this covenant, upon paying the Rent and performing its obligations contained or otherwise in this Lease, may peacefully and quietly haveshall be construed as a warranty by the Landlord to the Tenant as against any adverse claims, hold and enjoy encumbrances or defects in title to the PremisesLeased Premises existing before the Landlord acquired title, free from any claim or asserted by Landlord or persons claiming by, from or under any predecessor in title to the Landlord, but subject to all of the terms and provisions hereof, provisions of Applicable Laws and rights of record to which this Lease is or may become subordinate. Quiet Enjoyment. Landlord covenants and agrees with Tenant that Tenantupon Tenant paying rent and other monetary sums due under the Lease, upon paying the Rent and performing its obligations contained in this Lease, covenants and conditions under the Lease Tenant shall and may peacefully peaceably and quietly have, hold and enjoy the PremisesPremises for the term, free from any claim by Landlord or persons claiming under Landlordsubject, but subject however, to all the terms of the terms lease and provisions hereof, provisions of Applicable Laws and rights of record to which this Lease is or may become subordinate. Landlord covenants, in lieu of any implied covenant of quiet possession or quiet enjoyment, that so long as Tenant is in compliance with the covenants that Tenant, upon paying the Rent and performing its obligations contained conditions set forth in this Lease, may peacefully and quietly have, hold and enjoy Tenant shall have the Premises, free right to quiet enjoyment of the Premises without hindrance or interference from any claim by Landlord or persons those claiming under through Landlord, but and subject to all of the terms covenants and provisions hereof, provisions of Applicable Laws conditions set forth in the Lease and to the rights of record to which this Lease is or may become subordinate. This covenant is in lieu of any other so-called quiet enjoyment covenant, either express or implied.

Quiet Enjoyment. Landlord covenants that Tenant, upon on paying the Rent and on keeping, observing and performing its obligations contained in all the other terms, covenants and conditions required under this Lease, may peacefully Tenant shall, during the Lease Term, peaceably and quietly have, hold and enjoy the Premises, free from Premises without interference by any claim persons lawfully claiming by Landlord or persons claiming under through Landlord, but subject to all of the terms and provisions hereof, provisions of Applicable Laws and rights of record to which this Lease is or may become subordinate. This covenant is in lieu of any other quiet enjoyment covenant, either express or implied.

Quiet Enjoyment. Landlord covenants that Tenantcovenants, upon paying the Rent and performing its obligations contained in this Lease, may peacefully and quietly have, hold and enjoy the Premises, free from any claim by Landlord or persons claiming under Landlord, but subject to all of the terms and provisions hereof, provisions of Applicable Laws and rights of record to which this Lease is or may become subordinate. This covenant is in lieu of any other implied covenant of quiet possession or quiet enjoyment, that so long as Tenant is in compliance with the covenants and conditions set forth in this lease, tenant shall have the right to quiet enjoyment covenantof the Premises without hindrance or interference from Landlord or those claiming through Landlord, either express and subject to the covenants and conditions set forth in the Lease and to the rights of any mortgagee or impliedground lessor.

Quiet Enjoyment. Landlord covenants that in consideration or Tenant, upon paying the Rent 's payment of rent hereunder and keeping and performing its obligations contained in all of the terms, covenants and conditions of this Lease, may peacefully Landlord will do nothing which will prevent Tenant from peaceably and quietly haveenjoying, hold holding and enjoy occupying the PremisesPremises during the Term, free from so long as Tenant complies with any claim by Landlord or persons claiming under Landlord, but subject to and all provisions and terms of the terms and provisions hereof, provisions of Applicable Laws and rights of record to which this Lease is or may become subordinate. This covenant is in lieu of any other quiet enjoyment covenant, either express or impliedLease.

Quiet Enjoyment. 2.01 Quiet Enjoyment Landlord covenants that Tenant, upon on paying the Rent Rents herein provided and keeping, performing its obligations contained in this Leaseand observing the covenants, may peacefully agreements and conditions herein required of Tenant, shall peaceably and quietly have, hold and enjoy the Premises, free from any claim by Landlord or persons claiming under Landlord, but Premises for the Lease Term subject to all of the terms and provisions hereof, provisions of Applicable Laws and rights of record to which this Lease is or may become subordinate. This covenant is in lieu and encumbrances, easements, rights, covenants, conditions and restrictions of any other quiet enjoyment covenant, either express or impliedrecord.

Quiet Enjoyment. Landlord covenants, in lieu of any implied covenant of quiet possession or quiet enjoyment, that so long as Tenant is not in Default and in compliance with the covenants that Tenant, upon paying the Rent and performing its obligations contained conditions set forth in this Lease, may peacefully and quietly have, hold and enjoy Tenant shall have the Premises, free right to quiet enjoyment of the Premises without hindrance or interference from any claim by Landlord or persons those claiming under through Landlord, but and subject to all of the terms covenants and provisions hereof, provisions of Applicable Laws conditions set forth in the Lease and to the rights of record to which this Lease is any Mortgagee or may become subordinateground lessor. This covenant is in lieu of any other quiet enjoyment covenant, either express or implied.ARTICLE EIGHT

Landlord covenants that Tenant, upon paying keeping and performing, within any applicable notice and cure period hereunder, each and every covenant, agreement, term, provision and condition herein contained on the Rent part and performing its obligations contained in this Leaseon behalf of Tenant to be kept and performed, may peacefully and quietly have, hold and enjoy shall have quiet enjoyment of the Premises, free from any claim Premises without hindrance or molestation by Landlord or persons by any other person lawfully claiming by, through or under Landlord, but subject to all of the terms and provisions hereofcovenants, agreements, terms, provisions and conditions of Applicable Laws and rights of record to which this Lease is or may become subordinate. This covenant is in lieu of any other quiet enjoyment covenant, either express or impliedLease.

Quiet Enjoyment. Landlord covenants that Tenantupon payment by Tenant of the rent herein reserved and upon performance and observance by Tenant of all of the agreements, upon paying covenants, and conditions herein contained on the Rent part of Tenant to be performed and performing its obligations contained observed, and subject to exceptions to title set forth in Exhibit “C” to this Lease, may peacefully Tenant shall peaceably hold and quietly have, hold and enjoy the PremisesPremises during the entire Term without hindrance, free from any claim molestation, or interruption by Landlord or persons by anyone lawfully or equitably claiming by, through, or under Landlord, but subject to all of the terms and provisions hereof, provisions of Applicable Laws and rights of record to which this Lease is or may become subordinate. This covenant is in lieu of any other quiet enjoyment covenant, either express or implied.

Quiet Enjoyment. Landlord covenants that Tenant, upon paying the Base Rent, Additional Rent and all other sums payable under this Lease and performing its obligations contained in all covenants and conditions required of Tenant under this Lease, Lease shall and may peacefully and quietly have, hold and enjoy the Premises, free from any claim Premises without hindrance or molestation by Landlord or persons claiming under Landlord, but subject to all of the terms of this Lease, any ground lease, mortgage or deed of trust and provisions hereof, provisions of Applicable Laws and rights all matters of record to which this Lease is now or may become subordinate. This covenant is in lieu of any other quiet enjoyment covenant, either express hereafter encumbering the Premises or impliedthe Project.
